If it was a cruiser that pulled him over, he can probably subpoena(sp?) the video tape. When the video gets reviewed in court, if there is no water on the road...case dismissed.

You can take pictures, get printout's of the weather from CNN or whatever, but if a cop replies to the written dec. you're as good as guilty, so from experience, it's a waste of time to do all of that.

I had pictures, road surveys, printout of the weather the day I got cited from the Farmer's almanac and all that other bullsh*t for tickets 2 and 3, guess what, it doesn't matter, I was found guilty.

Bottomline, if an officer replies to the written dec. YOU'RE F*CKED.

That's when you prepare to take his @ss down in court in the Trial de Novo.

22349 (a) strategies to beat a downhill ticket

I was going down a grade on the 101 freeway and noticed a motorcycle cop to my right near the oceanside~ He had a radar as I saw him reaching his hand out, I proceeded to down shift and went 65 miles per hour. He still pulled me over for going over 65 mph VC 22349. He wrote 83 as the speed approximation and wrote 65 in the max speed box. Under the Radar/lidar unit he wrote MC 9140/LIDAR. I am not sure how I should fight this ticket~ Here are some of the circumstances: It was a foggy, wet morning, there were other cars behind, I have after market rims so my spedometer is not calibrated correctly. Please let me know if you have any strategies for pleading not guilty to this.

I'm sorry........you were speeding beacuse you had to downshift to 65 but he already popped you with his LIDAR before you did. You want to use your rims as a defense? That's your bad the speedo is off.

BTW, this is a thread from almost 4 years ago.......

OK, I know it's an old thread but I'd love to get a recap of Diz's technique.

Also, can anyone confirm Eric's statement that if you request your local court, they must oblige? And if there is a term for it, what is it? (Change of venue is complicated court matter in itself, so I doubt that is it.)

Have any of you guys tried that GPS program that alerts you to speed traps. looks interesting. I was thinking of trying out phantom alert. anyone with personal experience in here?

well back on topic. I just won my Trial by declaration case and got back 200.00 for a ticket I got on opening day, Dodger game.
