Buying used 2009 G37, transfer case leak found at mechanic- what to do?

Hi All,
So I've been in the market for a used G for a while now, had a few crummy experiences at dealers and decided I would explore the private market. I found a guy selling a 2009 G37x for $25,500 with roughly 39k miles on it. Clean carfax, good guy, seems like he took care of the car for the most part. He is the 2nd owner, he got it off a 1 year commercial lease (owned by gov't in RI) and he's not sure about how they kept the car/drove it. He didn't use it that much and when I drove it it felt just like all the other G's I drove. So i took the car to a private mechanic and the car checked out except for the following things:
1. Drive shaft seal leak detected -> from transfer case gears
2. Both engine air filters needed to be replaced
3. Change all fluids except oil
4. needs 4 new tires
5. 4 wheel alignment

The last 4 items are obviously regular maintenance things that can be easily taken care of, but it's the first part that really worries me. What does this leak mean? And could it foreshadow potentially larger problems to come? Is this something that is typical of the V36 sedan?

Also, where does my bargaining leverage lie? I would want him to address all the issues before I sign a check his way and buy this car, but is this potentially a car I should let go and pursue a safer bet?

Thanks!

I'd pass. I grabbed my G37S coupe loaded with 17k miles for $27k....and that's with 1 owner, clean carfax and no problems.

I'd keep looking if I were you.

Sorry bud
