I'm retarded...2nd ticket...need help !
 

So I'm driving to work on the 163 and try to pass this jackass who was going way under the speed limit...finally pass him (obviously a bit aggressively) but it's right at the 163 / I-15 merge...cop is coming in from the side of me from the 15 and I pass him...he pulls me over and says "well I was going 75, so I'll put you down for 80"

This is on top of my ticket for 103 in a 70 in february (which I haven't had my court date for yet) when I was on my way up to San Fran. There's obviously no way to get the 103 one off my record...but does anyone know of anyway I can get out of this...? I might lose my license...it was a CHP that pulled me over...I'm screwed. ANY help would be appreciated.

Maybe a Traffic Laywer??? I dunno... When I got my ticket for going 80 ealier I tried contacting some traffic lawyers but couldent get any resolution... if you decide to go this route.. hope you have better luck..

Seriosuly though, that sux! I gotta pulled over in my old Acura GSR on I-50 going.....well, lets just say the speedo was reading 125+ and gaining.......Hey I was hungry and wanted to get home to study! Well, that's what I told the CHP officer AFTER he stopped yelling at me to turn of the vehicle and put my hands on the wheel! Heh! It was sorta funny at the time...not now though!
Anyways, I suggest you plead not guilty......show up for your court date that is set.....maybe the offcier won't show-up and you will be off the hook! Worse case he will show up, still plead not guilty and see if you can speak to the Assistant DA who may reduce the charges like he did for me !! Lost some cash and got some points but I was free to cont. to drive. In CALI 25 MPH over the posted speed limit is an automatic loss of driver's license IF found guilty.
You could also try traffic school if you haven't recently? for you 2nd offense. Best bet is that the cop won't be able to make it for one reason or another! *crosses fingers*

Jedi, I dont believe that going past 25mph is an automatic loss of license. I got pulled over for going 97 in a 65 on the I-5 toward San Diego. Plead guilty and paid my fine ($250 after begging with judge). This was my second speeding ticket within 6 months, so I couldnt get Traffic School.

Anyways, I if I were you josh, plead not guilty and hope that the cop doesnt show up. The worst that can happen is you will get a fine and some points.

RaySur...thanks for reminding me...talked to him last night and he said he'd take care of it...on the phone he was like, "your officer is german, about 5'10", black hair...etc."

I was impressed and then he said, "that's why they call me Mr. Ticket"

So...we'll see what happens...thanx again for the referral.

I don't know bro.....in between the garbled speech and the hollering.......it sounded like the CHP officer said anything over 25 mph over the posted speed limit was a loss of license for 30 days if fopund guilty. Who knows.

That's not the case...I believe it's at the officer's discretion...I got a 103 in a 70 on my way up to SF and didn't lose my license...but reading up on the law...he could've taken me in...and there is also different violations that he can write you up for when going over 100...some VERY strict and some less strict.

Right.. over 100mph, they can move the charge from speeding to reckless driving (which carries stiffer penalties because of the perceived risk to other motorists on the road).. and I think they can haul you to jail on the spot, at their discretion.

Hey Josh, your story sounds familiar. Let me share my story. I got 3 tics within the 18 month period. I went to a 8 hour traffic school for the 1st and had it cleared. (no points & insurance did not go up) The 2nd ticket I paid the bail amount then set up a date in court (arraignment) and pleaded quilty I then asked the judge if I could go to traffic school (so the points wont affect my DMV record) He allowed me to go to 12 hours traffic shool, my record remains clear (no points). The last ticket a received I had no option but to pay and deal with the consequences. I received the ticket on the 15 going to Vegas, I was going around 125 or so when CHP pulled me over. He actually gave me the ticket for 99mph, he explained that anything 100mph or higher he would need to impound my car and take me in for reckless driving - LUCKY ME!!. One more note CHP officer's show up to court about 95% of the time.(I have a buddy who is a CHP and he confirmed) Hope this helps.

How did you get to attend traffic school for the second ticket? Isn't there a rule in California that you can only attend traffic school once in a 18 month period for tickets. Well, that what the clerk and the judge both sternly told me.

Youre right their is a rule, but if you ask the judge to go to traffic school, they usually let you. I learned this when I went to the 1st traffic school. Their is a difference though; first you have to do 12 hours instead of 8 hours and second the ticket is reported to your insurance but their is no point recorded on your record.
