Car accident legal advice

Just looking for some help for those who have run into a scenario like this or has had some experience.

Ok I got rear ended on a bright sunny Sunday afternoon. Going south on Yonge St near Elgin Mills area. About 2 PM at the intersection waiting for the light to turn green. I just took my foot off the brake pedal to accel, when I looked into the rear view mirror I see a Ford Ranger going full tilt - then BLAM!
Pieces of my car flying everywhere and well lets just say OUCH. I would geuss she was going about 60 -70kph.

I called the cops - and York region dude shows up assess the damage, he gets myself and the lady who hit us in a pow wow and asks for our stories:

Get her story----- I DOZED OFF.........

The cop did not charge her and told her that he drives long hours and feels sleepy sometimes too.

He then said that we must tow our vehicles to Hillcrest Mall Collision reporting centre. As they will process this as this is what they do. And it takes the work load off them. CAN YOU BELIEVE THAT!!!!!

So we both tow our cars there - CRC is CLOSED!!!!!! Anyways I am totally miffed, so I get the car towed to my shop. And I go back on Monday evning to do a report - the lady who hit me still has not reported her story.

The officers on duty cannot believe the events that have happened and apologized to me and said they will deal with the cop who was on the scene.

Ok - so now after doctor exams and a whole lotta Xrays, and some physio - I am feeling mightly screwed in the lower lumbar and neck area. Numbing in the legs and arms...lets just say I feel like a walking knot

Insurance company has written the car off $11G of damage. Funny I just bought this car not even 2 months......

Any suggestions on how I make sure I get compensated for pain and suffering.

OR better yet refer me to a paralegal or lawyer?

Sorry to hear about the accident Jerry.
Sorry I don't have a recommendation for you, but yes a lawyer will be required to pursue personal compensation.

Wow, sorry to hear about your pain and about the car. As InTgr8r said see a lawyer.

Funny, if YOU had hit HER then you would have the book thrown at you I bet. I got hit once by a lady, she was driving crazy. You could see where her son cracked his on the windshield. No charges. All I could do was tell the cop he should advise her to take her kid to the hospital, sheesh.
I'm sure there are lawyers that specialize in this stuff, perhaps check out the web and like always look for references.

Get some recommendations from friends and family for a good personal injury lawyer.

damn... sorry to hear what happened. i just got rear-ended about 3 weeks ago myself... and my car is still in the shop due to the damages. the adjuster assigned to me has been a royal pita to deal with.

i would seriously hire a lawyer in your situation and get some proper legal advice for your situation. have u already accepted a cheque from the insurance company? if not... don't accept anything until u speak to a lawyer first. i would have them handle the whole situation from here on out.

Thats the funny part I have yet to recieve a call back from insurance - they looked at this car Friday. And I called a legal firm Thursday. Most important is my spouses and I, longterm health care, muscles are in all the wrong places right now. And how am I supposed to golf like this...

Make sure you get yourself taken care of as best as you can. I was rear ended 3 times in about 2.5 years, the last time being in 05. I still have problems to this day with pain and arthritis from the accidents. I was being nice and didn't go after any of the people that hit me, but I am the one paying the medical bills now since the insurance people closed my case for me without me knowing it.

Thats exactly why I need a lawyer for this. I am already starting some treatments, but I have a very long way to go.

Yeah, good idea. I was in PT for months, for 3-4 hours a day unitll the insurance didn't want to pay for it anymore. I hope that everything works out ok for you.

Sorry to hear about the accident. Glad you are ok though. Get a lawyer and they will help you. Alot of lawyers wont ask for money until things are settled when it comes to car accident cases.

I don't practice in that area, but I've been through a similar incident.
You may be surprised to actually get a referral from the auto body that is dealing with your car. Apparently, they have people come through the shop and take pictures or speak to them about such things, and often times, some of the clients even speak to the auto body about such things.
Sorry, thats the only lead I can think of.

Hope you're feeling better and sorry to hear about the wreck
Also, get your policy details in hand, read the fine print. In some instances, once you've settled on the agreed amount of physical therapy/rehabilition services there is a window of time, subsequent to that, in which you can re-open the file and claim for more rehab/physio time if the injury still does not go away or flares up after the fact. You have to be able to show that it was related to the initial cause (ie the accident) in order to proceed. Insurance companies do not advertise this fact, but it is there.
You cannot live in pain/discomfort and should be afforded the appropriate treatment.
