Ticket question
Okay so my brother was driving past a green light and there was a car turning right onto his street from the street perpedicular to his street where there was a red light. The other person was taking the merging thing, I'm not sure what it is called, but at a red light they don't have to stop. It curves and there is a yield sign for them to get onto the street instead of stopping and making a right turn. Anyway, my brother drives past and the person takes the curve thing and she is about half a car behind him. My brother had his blinker on but the woman did not yield and he had a turn to make, so he sped up to make the lane change and turned into where he needed to go.
Shortly after an officer turned his lights on and he was given a ticket for making a turn in the wrong lane...My brother told the cop what happened and the he replied that my brother should have slowed down, let the woman pass, and make the turn. My brother's arguement is the woman should have yielded to him. Is there anything he can do?

From a safety perspective, he should have slowed down and let the other person pass. Using another person on the road as an "excuse" for your driving actions really doesn't do anything in court.
The older I get, the more "defensive" I drive. He can probably take it to court and maybe get the penalty reduced.

wen u take it to court jus say that she jumped in ur lane last minute and u had to "swerve" into the next lane to avoid an accident caused by the woman not yielding when she was supposed to.. i dunno if it'll work but i say u stretch the truth!
i would have to side with Will on this one. although the woman should have yielded, that would be a hard one to argue in court in my opinion. i don't know what the other circumstances were (speed he was going, type of car he was driving, etc.) but i have seen tickets given for less.
disclaimer: i am a fairly aggressive driver and i would have probably done the same thing in his situation. i do understand where you're coming from...i'm just speaking from the point of view that i think the judge will take.

Yeah you're probably right Will. I talked to him again about it and he told me he actually didn't speed up to pass her, just that the turn was coming up so he just switched lanes and his speed was 30-35. I don't know exactly what happened but he drives a RED boosted 240 so I guess the cop heard the spool and saw red and had to give him a ticket ha.
