just looked at the pics again... your g is in damn good shape compared to her civic, how the hell did you manage to crumble the rear quarter and all that mess but you just have scratches on your bumper and scuffs on your hood?

And it's somehow not your fault?

If you couldn't stop from 40, you were too damn close. Period. That, or your reaction time was in the crapper.
Lets straighten things up..

My eyes were focused on the road ahead of me, not at my speedometer. My speed i listed above was an approximation. I don't know if you have been in a wreck or not but everything tends to happen in a "blur". Therefore some details such as distance and speed may be hard to recall..

you dont think that coming to a complete stop on a 65mph tollway makes her at fault? My reaction time saved our lives. Do realize that this all happened in less than ten seconds...

Regardless, Its a hard situation to describe in words. She left my lane and I sped up. She jerked back into my lane. I went on the breaks. She then swerved back to the lane (lost control) to the right, realized she couldn't make it at the angle she was coming at, so swerved back into my lane and went to a complete stop.

I was going APPROX: 40mhp through the toll booth (when she was not in my lane). At the last second she swerved back into my lane, lost control, and hit the brakes so she didn't slam into the sidewall.

Think about it.

Sounds like she went into the right lane, you gunned it to close the gap, then she cut back and hit the brakes.

Either way. No one here can do anything about it. Go to court, tell your side, let a judge decide the outcome. Plain and simple.

Honestly, at that close proximity to the booth, you should have just let her figure out WTF she's supposed to do and lay back. I'm pretty sure she's going to "not remember admitting fault" when her insurance company contacts you.

It sucks though, no doubt.

No, I don't think her locking her brakes on the expressway makes her at fault. It happens. The reason she did it might make her an a$$hole (like she did with you) or a hero (to save a kid that ran out in front of her). Either way, the term "safe following distance" applies. You didn't have it - presto, you rear-ended her.

I didn't say you were a bad driver. I didn't say you really did anything wrong. In the description you provided, to me, it sounded avoidable. Two BOLDs above tell me even more. If you're not aware of your speed, your estimation of breaking time at any given time is at best a guess. I know it's often hard to maintain, but a car length for every 10MPH is the rule, and I know for a fact the G's brakes need less distance than most - OEM and all.

If I had an idiot in front of me like you had in front of you, I would have gotten as far behind and away from them as I could. You chose to pass and it bit you in the a$$.

Like I said - not trying to be a dick. I would have handled it in a different way, but you live and learn. I've been driving a LONG time compared to most on this board. I can't see your protestations winning anyone over in court, but stranger things have happened.

I'm glad your car wasn't completely f'ed up, you weren't hurt, and at least you have an argument as to why the accident happened. I hope it never happens to you, or anyone else here, again, but I'm sure it will. Too many idiots on the road...

We could argue all the variables all day long sir .

You said you could have avoided it differently... But with so many years behind the wheel you should know that variables such as traffic, cars in the surrounding lanes, cars behind me, side walls, children playing on the tollway and many others should have been considered before you attempt to handle it differently.

But we cant do anything about it. Whats done is done.

In the end we both walked out of what could have been a disaster with no scratches or bruises, and for that I am thankful.

Why would you be going even close to the speed limit where the accident happened? It's like 10 yards from the toll booth

Why do people think having a BBK will help you stop quicker? It will not make you stop any quicker than your OEM brakes, as once ABS kicks in you are limited to the amount of grip your tires can provide. If you want to stop quicker, get better tires.

Back on topic, sorry but I agree with GeeWillikers. It sounds like the accident could have been avoided if you did not try and pass the person. Sorry it had to happen though, accidents suck.
