It's never cut and dry, if you are backing out onto a busy street the cars on the street have the right of way. woRthy made it sound like it was both of their faults ... he didn't look for oncoming cars, and she wasn't paying attention to the road or going too fast to notice a car coming out of a driveway. It could go either way.

From my experience of dealing wit alot of customers insurance companies they will prob put yall both at fault or you 70% and her 30% so its hard to say who will win. No matter what she had the right of way but like beerviper said its never cut and dry. What did her car look like?

I think they'd prolly put you at fault because she was established in the lane of traffic and you were backing into it.. Sucks.. I hate seeing anyone hit, but especially a fellow G..
