December 2010 discussion thread !!!
So, Chapter 2 of my story...
I finally found someone who was interested in actually seeing the G. He and his son came out to my resort to check out the vehicle this past Monday. They were very interested in it. But I was up against, I believe, an IS350 and perhaps another older G sedan. Whatever the case, I was able to convince them to buy mine. Unfortunately, the justification for buying mine over the others required I lower my price. Reluctantly I said yes. $17k is the agreement (puts me $1500 upside down, but I just wanna get rid of it at this point).
After dropping off some paperwork from my bank to his, they tell him that they cannot finance the car because it has a buyback on the title (see my previous post regarding chapter 1 of my story). This of course is shown on the vehicle history report (carfax, etc).
So I go back to the internet trying to arm myself with knowledge, but now it's starting to look like a legal issue. I've owned the car for over 2 years and never realized it was a lemon when I bought it. Although I'm not certain, I'm pretty sure it's required that any dealer is required to conspicuously notify the buyer if the car is a buyback/lemon. And in this case, either I'm retarded, or that effort was not made.
FYI: I bought this car from Erber Enterprises in Longwood. Which was, at the time, running a website called autoselects.com. That website is no longer up. I had a coworker call the number they have and ask if they still sell cars. They said they don't sell cars anymore, but they specialize in extended warranties and repair work.
I just got home from work, and I decided, out of curiosity, to look at the paperwork from the sale of the car. There's two sets of papers. The first set I have signed with my signature and date. But no where in these papers does it say it was a manufacturer buyback. The second set of papers, it is hand written on the front page and the warranty (as is) page. There's also several spots where it says signature which is highlighted. But my signature is not there. No wonder I didn't know about the lemon thing. No one told me or showed me. They just wrote it in some papers and gave them to me.
I have a consultation appointment with an attorney downtown this upcoming Wednesday.
