And the dealership released the car without the conditions being signed by the "offeror(s)" meaning they really screwed themselves! Gets better and better, Can't wait to see the look on their faces when they see that they released a car without us agreeing the terms and conditions.

 

If I may ask.. what is your over all goal? Is the car giving yo problems or u don't want it any longer since u found out it was wrecked?

Although more info is coming to light about the dealership's shady practices - I dont think you have a case with them regarding the Carfax. Carfax & Carproof update their files as new information comes to light. Sometime, that info can take up to a year+. For this reason, Carfax states in their fineprint that they are not to be held liable if the information isn't accurate.

Unless you can prove that the dealership altered/edited/changed the Carfax to purposely mislead you - then I dont think you have a case unfortunately.

 

Car is actually awesome. I'm just pissed we were lied to, had I been told the truth we would have been offered way less or left, simple as that. That the door is a different shade of white and who knows what type of accident. We were lied to and shown not a full report, I can't explain it over the internet but I still have the report and it's like a half assed report. Just makes them look even worse.

Now if we try to sell the car its going to be way under valued because of that accident so I want them to either A) Pay us back in full B) Give us another car just like it or C) pay the difference between perfect and poor condition plus pay for any damages.

Planning to visit a body shop this week to see if its more then just that door.

What's funny is that where my fiance was suppose to sign to the "terms and conditions" she didn't so really she didn't agree to all those terms, guess they missed that too.

 

Well, I can tell u now.. They ain't gonna give u "money back" or as u state "A"... I truly don't think you will get "B" either.. What you might get is a lil difference on the price..that's after you take the body shop report back to the dealership and try to negotiate something with them. It sounds like you dont have much of a case. At most, the dealership might agree to pay for new paint for your door to avoid legal costs. Your other demands are not realistic unless you can prove that the frame was damaged and its a hazard to drive the car. For all you know it was a low speed accident in the parking lot; the door was just heavily scratched and needed to be repainted.

 

Well those are their options, I'm willing to sue them and spend money to make my point if thats the case.

I'm hoping the frame is bent, then I can sue for them putting our lives at risk.

At best you might be able to get a little refund. Depending on what you find maybe 1k bucks or something IF the dealership feels like being nice, or the prior owner/salsemen.

 

The difference in value would be your damages. So you have to question whether it's worth your time and legal costs to fight them for the difference in cost

I hope you realize there are two copies to the contract of sale. The dealer has one copy which is signed by you (and most likely is signed by them but doesnt have to be), and you have another copy which is signed by the dealer (but doesnt have to be signed by you)

 

^ Nope. I have the same exact copy they have, they had the white paper, we have the yellow and the pink went to the DMV. So what I have, they have, meaning she didn't sign where the terms and conditions were meaning it will show the same thing for them... If they can even find the file as they said they are having a hard time finding it, again just makes them look worse and worse.

I'm going through a similar situation where I purchased an 08 sedan in August and they refused to show me the car fax and gave me some other type of car report. I've had a number of problems with my car since I purchased it the first being that they sold it to me with a pinched brake line and the rear boot was wrapped around the axle. I went back to the dealership and they said it was caused by a blow out on that side and that they would fix it under warranty. Then a few weeks ago I went to a dealership to see about trading up to an 09 g35s and found out that my car had been in 2 accidents prior to me purchasing it!! Like in your case, they lied to me and actually sold me a car that was unsafe to drive due to the brake line issue. I immediately went back to the dealership I bought it from with the car fax in hand and demanded that they give me my down payment of $11000 back or buy back the car at what i purchased it for. They did neither and pretty much told me to buzz off even after being aware of all the issues that i've already had. To make a long story short, i've contacted a lawyer and am waiting to hear back as to what my options are but it seems as though we're the ones that are gonna be SOL.

 

Mexbball, I think your case is a lil different than Nismo... They sold you a car that put your life at risk. I think you have a case more than Nismo, I'm not a lawyer, but it seems that way.. I wish u luck..
