Another Trial Victory - DWI Skank Goes Down

Hey guys, I thought you'd be interested in hearing about yesterday's verdict. (I'm an ADA in NY)

After an 8 day trial with 4 police officers and the defendant taking the stand, it took my jury only 25 minutes to convict this woman. This was her second DWI, her first was knocked down to an impaired. This one was as tough as my last, since there was no reading and she never acknowledged her DWI right to take an Intoxilizer at the precinct. The officers included two PO's, one Highway Patrol PO (who during my trial was given the 2005 DWI Arrest award) and finally a Lieutenant from IAB who was the desk Sergeant on the night the defendant was arrested.

All PO's testified beautifully, but the Highway Patrolman was superb! Then the defendant took the stand....crying about being sexually abused as a teenager (she's 54 now) and giving her time line of events. Her time line left her an hour and a half short between the time she left one place and arrived at another. Drinking time! She claims that she NEVER had a drink at any time during the day or night. (Arrest made at 2:45am as she's "coming home from a homeless person's house after driving there at 11pm to give her $20 )

The real pleasure in winning a case isn't the victory....its the screams of agony that come from the defendant as the guilty verdict is read. Nothing beats the crying and carrying on that comes from her! It warms the heart better than any whiskey!

Now I'm two victories short of the DWI Refusal title, so I've got to get working on my remaining cases before promotion!

Nope, its why I LOVE cross examining defendants! I also got her to commit to a time line that gave her 2 hours to get smashed after she had to "relive" her sexual assault by her imaginary friend when she was 13. This woman was her own worst enemy and basically convicted herself.
