03 G35 Transmission Concerns.

I have decided to trade cars with my brother's(Rookie84) G35 with my STi as I need something more for daily driving and he wants more speed..
Anyways, he told me his car will grind 5th gear when going in fast but only in winter when the car is not warmed up. I know his car did not have his transmission replaced before. Anyways, would this cause a problem if the transmission doesn't get replaced? the car has around 40-42k miles. I am planning to go the TN kit route. I was just worried if the transmission giving up on me when I go turbo and there would be no warrenty left... Should I be worried about this little problem?

My 03 6MT committed suicide at 18K miles. After much much debate with the dealer and Inf customer service it was replaced under warranty. The new 6-speed trans, clutch, and flywheel cost the dealer close to $6K. They gave me tons of **** at 18K miles, I'd hate to go head to head with them at your mileage. BTW... my problems started with 5th gear grinding also. Eventually lost all gears after 3rd!

Thanks for the replies.. My brother has been having this problem for over 10k miles and the transmission is still holding up no problem. He only indicates that it happens when it is cold when the car is not warmed up.. I was just wondering if it's worth fighting with the dealership since they are not too friendly around here. Heck, I might just go ahead and do the turbo kit thinking of all the hassle with the dealership...
