Traffic Violation Help!!
I'm sorry that I am posting in the coupe forum, but it gets the most amount of traffic. Anyways, to make a long story short, I was involved in a car accident over a year ago, and a New York State Trooper issued me a ticket for unsafely changing lanes. Although he was not on the scene to witness the event, State Troopers have the authority to recreate the scene of a crime. I noticed today that he spelt my last name wrong on the ticket. Would this spelling error be enough to throw out the case? Any information would be appreciated, thanks.

Re: Traffic Violation Help!!
People think its way too easy to get out of tickets. "Oh he wrote down the wrong color"..stuff like that
As long as he got your license # and plate #, I dont think you have any chance of getting it thrown out on a technicality unless he REALLY screwed up (like wrote down the wrong name, wrong location, wrong car, wrong something else). But 1 mistake isnt getting you off free.
I'd fight it more on the basis of him issuing it when he wasnt even there.

Your screwed! Same kind of thing, no witness, everyone involved told a differnt story, and the cop blamed me!
He discribed my car wrong, said it was a chevy/explorer. (WHAT PLANET WAS HE FROM) Called it grey, its black. Spelled my name wrong, big time! I have a long polish last name and he phoneticly spelled it!
The report had the order of the accident wrong, but I was still last. Time of day was wrong! He said it was at night, when it happened at about 5:00pm he didn't get there it about 6:00pm and when everything was said and done, it was night!
And he had the damage to the cars wrong!
I still got fined!!!! And getting this changed, ha...... They haven't even looked at it yet to have it revised. It will be a year this May!

Re: Traffic Violation Help!!
Thanks for the responses. For the time being i'm going to try to get the trial rescheduled because i'm out of state (college). but if that doesn't work out, he also screwed up claiming the roads were dry that night. the main reason for my accident was the fact that it just started to rain, so the roads were at their most dangerous point. i found a website that sends in court certified weather reports, so that i can claim weather as the result of the accident. i'll let you guys know what happens. thanks
