insurance people plz help!

hi,
i had a flat tire couple days ago, and i called my allstate motorclub. they called a nearby towing company. the first tow guy came without a airgun and he couldn't undo my nuts. so he told me that his partner will come with a gun. when his partner came, he did not have a airgun either. then he just brought his tool and started to remove the nuts with his manual tool. this guy was really strong and he got the job done. but the problem is he scratched the part where the nuts go in. so my questions are:

1) can i get them to pay for my wheel? obviously they cannot be repaired since they're Volks

2) is it my fault that the wheels got scratched?

3) how can i approach this? do i call a lawyer or just speak to that company's insurance?

thanks in advance. please help me out.

It's always good to have a second guy handy to undo your nuts.

blitzjb,

i never knew you were a lawyer!!! with your knowledge of the law, how come you didn't assist maev in dealing with ducatiguy in a professional and legal manner? because it does appear (but i may be wrong because you may have had private conversations with maev) that all you did was stick up for ducatiguy. as a lawyer, i would have thought that you could have given him sound advice to better the situation. but that's just me.

Blitzjb is a Long Island Insurance broker, not a lawyer, but let's not start bickering again ok.
