California Lemon Law

Hi,

I am hoping to be an owner of a 2005 G35 Coupe with 43K miles. I will make my descision this monday.

The prices is really low. The dealer is offering it really low for a reason.
It was a manufacturers buy back based on Californias Lemon Law. Supposedly people take advantage of this law and rape the manufacturers all the time.

The sales guy claims it might be becuase of the brake issue, but I thought that was 2003 -2004.

I am willing to take a chance, the original owner drove it for 40K miles...why/how if it was a lemon? I will verify that there is a clear AZ title before closing the deal.

Anyway...anyone have any insight to this subject?
Can I find out why the car was bought back?

I am not sure about California lemon law but in New York I believe the same problem has to happen 3 times and not-fixable. Not sure how you find out though..... Did you run carfax?

is it a 6mt? oil consumption could be a reason why it was a buy back .

Carfax + independent inspection for EVERYTHING.. other than that, I don't know how a car could be bought back as a "lemon" with 43K miles on it

thanks for the input.

Its clearly stated on the Carfax = Hard to sell when I am ready to get rid of it.

its still under warranty. I assume that if a repair was done under warranty it would show up in the carfax, but I did not see one.

Not necessarily. The guy who owned my car before I bought it tried to go all fast and furious on a corner and ended up sliding into a curb doing $8000 worth of damage. Got brand new wheels and suspension on one side, bumper, etc, and the carfax came back with no mention of anything.

He went through his insurance and even had the receipts to prove it.

8000 worth of damage that accident report was filed (police involvement) is supposed to show up on carfax. I believe if it is over 1000 dollars it shows up, i know sometimes it takes abit of time...... Warranty work will not show up on any carfax. A dealer told me once that autocheck.com is actually abit quicker to update than carfax, plus significantly cheaper, i think 25per month vs 40. I have used it as well

I think you can have some piece of mind buying from a dealer, they are going to have to back up vehicle and you still have some remaining factory warranty left.

Yeah I thought it would show up too, but he had the original receipts from getting it repaired and it had been over a year since it happened...

The dealers will have a record of any warranty work that was done on the vehicle (they keep track of everything) and can print it out for you in the service department if you have the VIN.

Did some research, in Cali a lemmon is one or more of the following:

1) The need to repair a item a second time that can cause the loss of a life.
brakes, airbags, etc

2) Repair of something that is needs a 4th repair.

3) loss of vehicle to repair work of 30 days or more, which can be accumalative.


All has to be while car is under warranty. Even if the car is used and is sitll under warranty. Cant be from and incident called from the owner by accident or misuse.

In most cases a judge has to make this descision.

So, $8K in repairs do to an accident would not justify a lemmon, regardless if it was claimed on insurace or not.


I am going to ask the dealer to give me the paperwork on why the car was bought back...maybe the owner complained about the tire wear 4 times and got all his money back.

Um... my comment about the $8K in repairs had nothing to do with lemon law; I was using that as an example of how lots of stuff doesn't show up on carfax even though the vehicle was damaged and it went through an insurance settlement...

I can attest to this.. previous car I got into an accident with; no one else involved, police weren't called.. but $7k of damage covered by insurance and it never showed up on the Carfax.

Dude NO offense to you or the guy you bought it from but I have go to ask the million dollar question that I am sure many are thinking. Why on earth would someone wanting to sell you a car that had 7-8k worth of repair work done on it and it WAS NOT listed on car fax embelish to you??

I appreciate the lads honesty, but how many people would do that and how many would buy a car knowing that as well.

Well he was honest and upfront about it, and I saw all the original reciepts/ work orders from the shop that fixed it... whats wrong with that?

For the record the main reason it ended up costing that much was because they had to replace both the 19" rays, all four tires (something about it being hazardous to only replace one side), and some misc other stuff that was scratched/ bent when he slid into the curb. If he hadn't told me and given me the repair paperwork no one would have known it ever happened. The Infiniti 160 point inspection even came back with "no sign of previous accidents or damage."

Called Consumer affairs.

The car is still under warranty till october 10, 2009 or 60K miles and powertrain till oct 10,2011 or 70K miles.


I am still waiting from dealer to see what the original buy back was all about.


I have a feeling I will be G35 onwer soon.

Never bought it...Now own a 2007 G35 Sedan.
