Speeding Ticket.

Wassup G Owners? I need some advice. I just got pulled over earlier tonight by a State Trooper for speeding. I was on my way to walmart when my brother in law called me and told me that my daughter was crying bad(he was babysitting) cause her teeth are coming in,So i turned around and went back home doing about 80 when a state trooper pulled me over out of no where,my radar did'nt even catch him. Anyway he said I was doing 90 in a 55,I told him the reason why i was speeding and he just kept talking madd sh*t saying "You Dont know English?" "You Cant read the speed limit" etc and wrote me a ticket. Now I have to show up in court Sept. 16 04, and all my friends are saying that Im done.....What Do You Think? Anyone ever delt with this situation? Please give me some advice. Thanks!

The cop was right man, no denying that was very fast, BUT he could have shown a little heart.
If it were me, I'd explain to the judge exactly what happened, that you didn't want to endanger anyone, but were very worried about your daughter and that you needed to be with her ASAP.
Tell him/her you're guilty, but that you feel there are extenuating circumstances.
Provided you have a good record, the judge would have to be pretty hard nosed not to reduce the penalty.

I would probably look into getting a lawyer for this one. 35 mph over the speed limit will get you a serious penalty if found guilty.
The judge will not likely show leniency because you tell him that you were wrecklessly driving because your baby was teething.
No offense but judges have heard it all and unless you get an unusually soft judge, you'll be found guilty.

normally i would say plead not guilty and see the prosecuter and bargain it down. but 80 is a bit much. get a lawyer, because the judge probably used to be a lawyer and as long as someone is getting PAID, then they'll go easier on you.

Lawyer will be cheaper in the long run (read: school and insurance hike). Just curious, did you see the radar reading?

Wish you recorded the conversation. I'd take the ticket but sue the cop for racial discrimination. (I am assuming you are non-caucasian.) That kind of tone is completely impropriate for a public servant.

Keep in mind the officer is not there to judge. Only to observe the violation as a witness and cite you for it. The courts decide if you are guilty and what the penalty will be (if any).

Out of context those questions could be very valid for an officer to ask. True the tone that the original poster implied the officer used in his post would lead anybody to believe it was a slurr, but textually, you wouldn't have a case if argued in court. IMO.

I always try to handle these myself before getting one of my lawyers invovled (I've got 3). Read this post, similiar situation. Remember that every state & county handles things a bit differently.

in NJ, if you show up, you get meeting with prosecutor who will know ticket down to a lesser charge. sometimes with points, sometimes without.

friend was given option, no point ticket that cost more, or point ticket that cost less.

i just read the link you sent me, honestly, what would you do if you were in my situation? this is my second speeding ticket in 2 years. Also, on my ticket, it doesent say anything about him clocking me on his radar. thanks for your help.

your daughters teeth coming in and her crying due to the fact doesnt justify doing 80mph... If I was the judge, I'd hit you with court costs as well just for wasting the courts' time....

In all honesty, getting to your daughter faster isn't going to miraculously make her teeth disappear and the pain magically go away. I woulda kept going to walmart and got her one of those cold packs that they give kids to put in their mouth to calm the pain, instead of doing 25mph+ over the limit to get there endangering your life and those around you....as well as giving your daughter the oppertunity of growing up without a father...
