Re: Traffic Court Questions (California)

That is what I thought....

So, I am hoping that when I go in on Monday, I will explain to the court that this is my first ticket EVER (well, ever in California, but I don't think that they will check my driving record in NY, since I have been a resident of CA for 4 years), and hope that they grant me some lienency and reduce the fine... But by requesting that, aren't I admitting that I am guilty? Is there any way to talk to DA before I walk in the courtroom? What is the best way to go about plea bargining?

I figure that this is one option, because if they give me traffic school for this big ticket (33mph over), then I don't mind pleading guilty to the smaller ticket (18mph over) because it will not hurt my insurance as much (+, this ticket was in a county more than 2 hrs from my house, so I am not fighting it)...

The other way is just to plead not guilty, request a motion for discovery, hope that they don't send the materials I request or hope that the cop doesn't show up on the court date.... Those two are long shots though IMO....

pleaing traffic school is not admitting to guilt, its like "no contest"... (whatever that means...)

Re: Traffic Court Questions (California)

Hey everyone,

Every story needs closure, so here is how mine ends. I went to traffic court today and the judge said the wrong infraction:

Judge: I see you were speeding in a 65mph zone (actually, it was a 50mph zone) and that you are eligible for traffic school.. fine is $182...

Well, that sounded great to me because the actual fine was $355 and I was doing 33mph over the speed limit, where you are not supposed to get traffic school for more than 25mph over... So, instead of fighting (I was very wrong and easily identifiable), I took the deal and traffic school... I have another ticket pending in a town 2 hrs away, so I will do the trial by mail for that one. Thanks everyone.
