Angry Got Into An Accident

So last week while going about 50 mph, I approached an intersection with a vehicle going the opposite directions waiting in the intersection for me to pass. Unfortunately, the car behind her was impatient and didnt want to make. She proceeded to make a u-turn behind the vehicle and I nailed her. Slammed on my brakes the best I could but still had damage to my G.

She was cited for unsafe lane change and failure to yield to oncoming traffic but you could tell she didnt care. She asked me "why are you yelling at me" and "youre lucky I stopped". She was a real gem! Anyways, the car is getting towed to a collision shop this afternoon and I was wondering what the policies are for repair (i.e. my headlights need to be replaced so can I get 2006 headlights instead of the 2003 or instead of an OEM front bumper being replaced, can I get a Nismo). Do I even have a say or is it just in the body shop and insurance companies hands?

It hasnt been assessed for damage yet (still waiting) but he mentioned the possible S word (salvaged) but they wont know until later.

No one here can answer your question. You will have to speak with the shop doing the repairs.

But there is a very good chance it will be totaled. Assuming no frame damage and no air bag deployment; just hood, bumper, headlights, quarter panels, grill, core support and paint, you are in the 5k range.

Yeah, I didnt think anyone would be able to answer that but was hoping someone with past accident experience might know. Yeah, no bags deployed but still a lot of damage to the front passenger side and with it being a 2003, $5k buts it over 50% of the vehicles value. Yikes! And her pos car was driveable with a puncture in the rear bumper from my fender. Ugh!

Pictures still dont work. But aftermarket upgrades all depends on the shop, some will do it and some wont. You can choose where your work is done. Call around the area and ask. Find the shop you want and have your work done there.

Just hope for a total and start over.

think i got one of them fixed. hopefully it works now. sorry. yeah, almost hoping at this point it is totaled so i can start fresh

The headlight from a quick glance doesnt look damaged but has some hard surface scratches from the wreck and some busted platic pieces from the inside housing floating in there now.

all depends on your insurer really. aftermarket replacement is a gray area. Most shops will fix the car as it sits if you have full coverage and can provide receipts for anything aftermarket. Some insurance companies will replace anything damaged with OE replacements even if you have a body kit or aftermarket wheels or something. a lot of insurance companies now have a section where you can insure aftermarket parts value up to a certain amount as an option you can select in the policy. Did you have full coverage or liability? If you only have liability and have to rely on the other insurance company I say GOOD LUCK. just did that song and dance a few months ago and opposing insurance companies will go to great lengths to try and *** you down as far as possible. But you will have to call your insurance company and find out. If your car didnt come with projector headlights from the factory and you didnt already at least have them on the car, I highly doubt they will spring for them. Then again if you know someone with a body shop they might be able to just install the projectors anyway and bill the insurer for it. When it comes down to it, the insurance reps really dont give a **** because they arent the ones paying for the damage. They're gonna get paid either way. Theres a lot of loopholes and weirdness with insurance claims so good luck man. Sorry bout the car.

ugh. I hate to see things like this. I cringe every time they wreck the nice cars in movies too.

these are the situations where owning a truck seems more and more like a good idea. You would probably have a small dent, and she would have been the one going home on a trailer.

Anyways, from the pics, looks like the hood is bent a bit. good excuse for an upgrade to a new carbon fiber hood! haha

Some companies don't even allow you to choose that value, and have it as a fixed value for all of their customers...

This is right on point (except for the jew comment ) anyway it really does depend on the shop and if you have aftermarket parts insurance. Most body shops are in the money making business, not custom body work for OCD G35 owners who are meticulous (like me .) It produces more paperwork, more transactions, what the insurance will pay for what they owe (OEM Bumper), what the client has to pay to upgrade the part (NISMO bumper) and puts your car on the lot longer....time equals money. Why wrestle a custom G35 job when you can push 4 accords thru the insurance company, get em off the lot in a few days and get paid in full. These shops deal with the insurance companies directly daily and get payments sent right to them minus your deductible if you have one.

I worked at State Farm for awhile and this was a constant issue. Unfortunately i would also guess your policy allows for LKQ parts (Like Kind Quality) which in insurance world is equivalent to OEM for some companies.

But like 5 people before me said.....it all depends on the insurance company and the shop.

I literally went through this a month ago to date. I was involved in an accident and it was at speeds a third of this. My frame was bent in the process and damage exceeded 12K.... so I was just given a check to buy a new vehicle.

Talk to your insurance provider, the bodyshop cannot get around the instructions they are provided. Ultimately its up to them.

Best of luck moving forward from this accident, try to avoid the S word.

BlackBeachG35, I think there are still quite a few insurers that dont even offer aftermarket coverage. My current provider (progressive) let me choose any amount of aftermarket coverage up to $5000. Then again before I was with progressive I was in an accident and only had liability on the car. Even though the accident was 100% the other parties fault, they fought my tooth and nail when it came to adding value for aftermarket parts. Even after producing over $4000 in reciepts they basically told me to shove them all up my a$$ and gave me an extra $75 towards the total value. (thanks...)

But thats the catch with aftermarket parts. I called the state insurance commissioner about what had happened and he told me there are absolutely no regulations on how much an insurer is obligated to pay out on any type of modification. If they are generous enough to add any money at all.... They have complete control over that aspect of the claim and It really is a crap shoot...
