Ahh yes, TX and it's wierd insurance laws. It can vary from state to state, but perhaps some states allow policies that deviate greatly from standard ISO policies. In CA, btw, if you do not identify the other vehicle or driver enough to be able to know who he is(usually a plate#) the UMPD(uninsured motorists property damage) coverages will not apply. I guess there was too much fraud involved here. UMBI(uninsured motorists bodily injury) will still apply though if there was direct physical contact with the uninsured vehicle. I'm sure there is several variances from state to state. As Dongou said though, read your policy. It's your contract with your insurer. Whenever there is a question of coverage, the policy is what you ultimately refer to.

CKwik, I appreciate your comments. I spoke to a friend who happens to be a claims adjuster. He told that since I promptly filed a police report as a hit an run accident, then my UMPD coverage should be the one paying for the damages and it should NOT count against my premiums in any way. By the way, by law in the state of TN the deductible for UMPD is 200 which is lower than my 500 collision ded.
