Totalled avoiding a deer. NEED ADVICE

Ok so I wasn't driving the G35 but I was in my 240sx coming home and 2 deer ran out from bushes right in front of my car. I tried avoiding them and ran into a curb that sent my car flying into the side of a hill. It happened on redwood road in the Bay Area, CA. Well I'm only 17 and of course they put me at fault. I need to know what to do when I appeal their decision. Having something like this on my record is going to screw up my life till I'm 25. It would have been better if I hit the deer because it would have gone under comprehensive but who knows what would have happened to me in that situation. Please guys I need help badly!

Sorry to hear... shoulda just hit the dear...
Kinda like the dumb*ss veering into your lane... don't try to move out of the way. If you hit a curb, your dumb*ss is paying for the damages yourself.

I totally understand you. It's a human reflex to dodge obstrucle. I had an similar accident earlier. A car on the right forced to cut into my lane and i dodge him by hitting the car on the left. Yup, techically it was my fault, but I know in heart it wasn't. Hope everything works out for u.

agreed...its not worth avoiding any...you will be end up paying all the dmg or insurance, etc
i am in opposite end of country so cant really help but...
you need to talk to specialist since you are only 17. probably, friendly insurance agent. he/she probably will lead you to right direction. at least i hope

I can't help you with the insurance thing (my opinion is that you're scr*wed, just like all of us were at 17, sigh), but I did want to sympathize about the 240. Another one goes to the Big Track In The Sky. I lost mine in August by hitting a bison in Yellowstone.

Sigh. My sympathies. Fortunately, the G35 coupe is a nice replacement.

There's nothing you can do. Their position is that you should always have control of your car. The only thing that may help is if there were extenuating circumstance, like it happened at night and there were no street lights. Good luck.

I'd suggest talking to a lawyer who will know your options. You're right....you don't want it on your record and it's worth fighting.

I went to drivers improvement yesterday and came across a story similar to yours. They suggested that in the event that you come across a deer it to hit the deer head on as opposed to dodging it. For Insurances purposes they will cover you because deer is covered inder comprehensive. Being that you decided to avoid it and hit something else is generally considered your fault and you end up paying out of your own pocket. Also if you ever come across another deer againthey say you should punch the gas rather then the brake. If you brake your car will cause a nose dive and when the impact hits the deer it is liable to go through your windshield and kill you. If you accelerate atleast you lift the front end up of your car limiting the chances of the deer going through your windshield.

If the animal is small enough then run over it. Too big to run over, try to hit it head on . Hard to do but maybe safer than trying to avoid and doing even more damage. At least if you hit an animal there is evidence of the reason for the accident.

some people dont wanna live knowing that they killed something so huge.. maybe if it was a small bird then they wouldnt mind.. even small birds i try to avoid running over, its not necessary is it?

no matter how much you appeal you wont get it off your record its your fault for not driving "safe" enough. i say this because i work for state farm.

its easier said then done to simply hit a deer head on...I bet most drivers would try to avoid it...it seems like you have no witnesses so you might be stuck...but I think your situation would warrant you getting a lawyer...good luck

Shame about the car and your driving record. You did the right thing and the natural thing in avoiding hitting the deer.

It might be worth speaking to a lawyer to get some advice on your options and success possibilities with their counsel.
