Is it a lemon? i shoulda gone to toyota of orange....

This has nothing to do w/ Toyota of Orange but that song got stuck in my head. As for the lemon, yes I am really wondering. I have ALL service records of the car and all warranty work done at dealer. Here is my list:
Original Tranny: Grinding 5th gear - replaced
2nd Tranny- Grinding after 2k miles - replaced
3rd Tranny- no grinding as of yet only on cold starts and cold days/hard shifts
(i know how to drive a stick trust me, ive driven many before)
Window operation- window would not roll up at all - motor replaced
Window operation 2 - window would roll up then roll back down - fixed
Window operation 3- window AGAIN rolls up then rolls back down - going to dealer for it
Bose stereo- crapped out, replaced
Rear axle clicking- fixed/replaced
10k miles - clicking again going to dealer again
Air bag light flashing for no reason - going to dealer again

Thats A LOT of problems considering ive had the car for about 14 months. I got it pre-owned at Miller with about 20k miles on it.

Im getting pretty agitated with the car. This is besides the CRAZY rattles and squeaks, but im assuming that comes from the coilovers on the car. As for everything else, enough is enough. What are my options?
Thanks for listening to the rant.

not sure what you mean by 'lemon' -

(1) legally, it does not sound like a 'lemon' - but you should look up the specific lemon law for your state. for VA, the law makes it pretty hard to classify a car as a lemon - something like: the same problem need to occur 3 times within x months, the dealer AND the manufacturer gets 3 tries to fix the same problem, it takes the dealer takes more than 30 days (in sequence) to fix the problem, problem must be outside of safety specifications margin of error, etc..... (mind you, all of this pertain to EACH problem independently)

(2) if you're just asking if it sounds like a lot of problems, yes it does. you said you bought it pre-owned? did it have any accidents, any problems like flooding, stolen vehicle recovery, etc.. ?

anyway, good luck. if you really get sick of it, i'd say just sell it / trade it in and get something else...

google federal and state lemon laws. sounds like you have a very good case to unload your lemon and get a new car.

according to state law i have 18months or 18k miles, neither of which have been rteached yet, and reasonable attempts to fix the problem. i think going in for the 4th time would be a reasonable attempt. im just sick of my baby (whom i love) giving me all these problems

I'm not trying to make a blanket statement, but all the problems you described are pretty common on the g35.

My car is automatic, so I haven't had transmission problems....but everything else you described happened to my car as well....not to mention my driver's seat squeaking like CRAZY.

Have you spoke to a lemon law lawyer?

Dude, just trade the car in and be done with it. Take it to the dealer and see how much audi is willing to give you

first, good luck with that - i hope it works out for you.

that being said, the reason why i knew a little about VA's lemon law is bc i tried to get my new vehicle (motorcycle) classified as a lemon and get reimbursement. long story short, i did not win, and i've come to realize that in VA it's pretty damn hard to win a lemon law case unless there is a problem that cannot be fixed no matter what AND it causes a direct safety risk to you. what's funny is that in the end, i agree with the way the law is written. jsut want to share my experience.

if there is one tip i can give you, it's that you should work with INFINITI and not the dealerships. in case you don't know, the dealerships are not considered under the infiniti corporate umbrella.

oh for sure I will be working with the corporate side, not with the dealerships (who dont know much as it is. I was reading the laws for Ca, and it says motorcycles etc are not under this law for some reason. Maybe VA is the same??

Sorry to hear but you just got the bad cookie in the batch. This is more of a reason for you to purchase the extended warranty. Only thing dealer will tell you is to keep bringing your car down for service and they'll fix it under warranty. Sorry again brah

You said this was a used car when you bought it. Does your state's lemon law apply to used cars or only to new cars?

I was in the same boat... just a little more excessive than your situation. Even mine, when my car was in the shop a month+ at one time for my tranny/clutch did not fall entirely under the lemon law. But most of my problems, as well as yours will fall under nuisances, and the manufacturer has the right to have a chance to fix those problems under warranty.

First off, there are two different approaches you can take. Federal law or state law. Federal law is more lax, but compensates you less. State law goes a little further, but depending on which state you live in, it can be consumer or business friendly. Either way, the onus is on you to prove it is a lemon. The lemon law is much different for a used car than it is a new car. the 18 months, 18K miles don't really apply to used cars since you can buy one that is much older or with more miles. Plus, it being used, there is slightly less protection for the buyer.

In the end of it all, you most likely have to prove that you were put out by the problems. In other words, unable to use the product within what is defined as "normal" or reasonable usage. If you are still getting things fixed under warranty, then make sure you get everything fixed or documented before your warranty ends. I've talked to California Lemon Law lawyers about my case, and frankly, it is a pain in the a$$ to deal with the problems, and that is about all it will be in legal terms. If anything, they can hack out a compensation deal w/ nissan for the trouble and time you were put out on due to the numerous problems. I think they were offering me $2K in my last consultation.

I'm still unclear about everything that goes into lemon lawing a car in Cali. Talk to a lawyer if you are serious about it. The best thing to do. No guess work, and free consultations and if you win the case, no attorney fees.

Best of luck.
