I would just verify with them. Just say this is going to be a comprehensive claim, right? And see what they say. Just make sure you explain it the way I described, and you should be fine. If they are going to pay out under collision, I would probably pay out of pocket for it.

OK verified with this wit USAA and it is definitely covered under teh comprehensive policy.

My next step is to have them examine the car and give me the quote. Since this is comprehensive and I have a 500 dollar deductible if it comes in around 700 or so do you think i should proceed with the claim any way?

Thanks again for the inside information.

Eh, it's up to you. You can lose things like incident free credits and any built up credits for accident forgiveness. All of which depends on what the insurance company has available. I guess I probably wouldn't if it were only $200.

If you do decide to go with the insurance try to see if the body shop can get you a deal on the oem lip along with a new bumper cover.

Get out of my head. I called Lokey intfiniti and FGC sponsor and got prices on the oe lip and bumper and it appears that is the route I am going to pursue since I am not find anything on the aftermarket for the 05.

Does it really matter if it is claimed through comprehensive vs collision? It is a claim and wouldn't his insurance go up anyway?

Yes, it does matter. Comprehensive claims will not affect premium, while a collision is considered an at-fault accident, regardless of whether or not it was un-avoidable. To the insurance company, "You should be in control of your vehicle at all times". In a comprehensive claim that is not a factor, because the claim is considered an "Act of God" or something that you have no control over (like falling objects, vandalism, glass breakage, hitting an animal, etc). For instance, when a rock cracks your window and you don't get a premium increase for the repair. That's why people always file glass claims, because they know it will never affect the premium.

OH, BTW...Hitting an animal is one of those exceptions to the rule in terms of comprehensive. While it can be possible to avoid an animal, it is still considered comprehensive and NOT collision. So if it is between swerving to avoid hitting an animal and hitting something on the side of the road instead, HIT THE ANIMAL!!! LOL....Seriously though. Because they will pay the comprehensive claim for hitting the animal, and your rates will never go up. But if you hit that object on the side of the road because you were avoiding the animal, they will call it a collision claim and you will probably get surcharged if the amount exceeds the threshold in that state.

What if a really old person with a walker darts out in front of you... Do they pay double j/k

Everything you advised of us here I applied in my conversations with my insurance company. The act of god stuff, aka comprehensive, and collision I pretty much just asked a bunch of what if questions seeming as if I wanted to learn somthing I wasn't already privy to and all the answers fit according to your statements.

As regretable of a situitaion this is at least I got an education along the way. Thanks.
