Help!!! I'm new - heat issue

Help!
I'm new to this site.
My wife drives a 2003 G35 Sedan and since day #1, the car has had heat coming from the driver's side foot-well air duct. If you turn the climate control system off, you still get steady hot air from this vent. This sucks in the summer. the only way to get rid of the heat here is to turn on the A/C and have it come throught this lower duct.
Does anyone know why this happens?
Is this a common problem?
Does anyone have a fix recommendation?
The dealer is clueless and so is corporate apparently as we've written a letter and have since had no one step up to the plate and acknowledge the problem and recommend a true resolution.

That is definitely unacceptable and should be covered under the warranty. Take it to a dealer and have them fix it. Even if they are clueless they still need to fix it under warranty. Or try another dealer.

There are a lot of threads regarding this issue. I cant remember if I saw the how to here or on FreshAlloy but someone put together a step by step on how to fix it. Involves plugging up a few holes in the engine compartment with foam. Pretty easy fix. Try a search on both forms and you should find it.

Extremely odd for owners to be caulking holes in a new car. Is Infiniti aware of this issue? My car only allows warm air in the footwell area when the a/c is off.
