Re: Accident
I thought about this too but I think if Infiniti provides a switch for turning VDC on and off, there's no reason why you can't turn it off and retain your right to insurance and the presumption that you where in control of the vehicle.
I don't see any reason to speculate about the merits of VDC in Fireball's accident but I do believe that VDC is singularly responsible for saving my a$$ (on at least one occasion) and I wanted to know if it hadn't been helpful.

Re: Accident
VDC has saved my a$$ a couple times, too, both times on wet roads. I like to switch VDC to its "low" setting on dry roads. Remember, we can't turn it completely off.

Re: Accident
Sorry about your accident.
Sorry for the hijack but last Friday I was rear ended on the highway and I wonder if I had VDC on if I could have made it without getting hit. Everyone in front of me came to a sudden stop so I slammed on my brakes (which work great) so I didn't hit the car in front of me, and came within about 2 inches from hitting him. As usual, I immediately focused on the rear view mirror and saw a car coming up quick. By this time the car in front of me had moved up about 5 feet or so and was accelerating. So I mashed the gas hoping to avoid getting hit but just spun my tires (5AT)... got a few cracks in the bumper so I'll need a replacement, but no big deal really. I just wonder if I'd had VDC on if I could have got enough speed to avoid getting hit at all. But this all happened within a few seconds. Ah well.
Everyone be careful out there, especially this weekend!

Re: Accident
Since the air bags deployed there is a complete and precise record of every system and drivers action: speed, time to brake, distance to impact..........every thing necessary to save or cook your goose.......stored permanently burned into air bag memory from 5 sconds prior to bag deployment.
When there are deaths, these modules are recovered [confiscated] and sent to specialists to decode for use at trial.

Screen names don't hold up with a court order, everything is cached and IP address traced to ISP and their logs shows your password and phone number/dsl/cable IP.
Every utterance can come back to haunt you.
Not worth the effort unless big sums are at stake.

Re: Accident
Since there weren't any other parties involved, major injuries to myself, or property damage, I can't see why anybody would even bother to analyze the car's memory for the stats at the time of the accident.
As stated earlier, since Infiniti provided a switch to disable (or lower the threshold of) VDC, there's no way that my insurance can claim a loss of my right to coverage. Nothing that would be related to the handling of the car was modified. I did not do anything other than try to avoid another car and lost control.

Re: Accident
"If Fireball does not mention his real name and address, I'm not sure how his [anonymous] comments could be used against him here or anywhere else..."
In this instance, given the circumstances of the accident, I doubt whether anything that Fireball posted would be used against him.
However, in general, it's not a good idea to ever make any statements accepting blame in an accident. Competent investigators know how to find this stuff. As for anonymity, the posted images and description would conclusively link Fireball's posts to his accident, even without a name or address.
Again, I'm really happy that Fireball wasn't seriously injured, and I think that he'll come out of this OK. I also know that posting about accidents helps people deal with them.
But, as I like to say, "Just because you're paranoid doesn't mean that they're not out to get you."

Not to beat a dead horse, but the above statement is 100% correct. I am a lawyer and I can promise you that if Fireball's accident did lead to litigation, then this could come back to haunt him. No IP logs necessary. The way it would work is that his deposition (oral examination under oath) would be taken by the opposing lawyer. The lawyer would ask him some foundational questions such as, do you use the internet? are you active in any discussion groups, bulletin boards, etc? what are your screen names? etc. Then he would pull out a printout of this thread, complete with a description of the accident and photos. The lawyer would ask, "Did you write this?" and Fireball's only truthful answer would have to be, "Yes." It's very risky business to lie under oath, so most people don't do it. You don't have the option of saying, "You can't prove I wrote it." You have to answer, yes or no.
Personally, when I take an opposing party's deposition, I ALWAYS, EVERY TIME ask questions about e-mail addresses, screen names, discussion groups, etc., even if I don't know of anything they've written on line. Then I go back to the office and Google them to try to find any useful admissions or contradictions of their sworn testimony. I have yet to uncover anything like Fireball's description of his accident, but one day I surely will.
I understand why Fireball isn't concerned about a lawsuit here and I wouldn't be particularly concerned in this case, either. But in a situation with injuries to another party I would not say or write anything about it, including supposedly "private" e-mails to friends and family. An opposing lawyer can get those too, just by asking.
Lawsuits are bad, bad news. I would never want to be in one.
For reference, see Rules 30, 33, 34 and 45 of the Federal Rules of Civil Procedure, or your state's equivalents.
Not trying to start a flame war, just setting the record straight. Hope this helps,

Re: Accident
Glad to hear your ok... I did about the same amount a damage to my G35 and the insurance company decided it was recoverable, which im not happy about. I posted pics under the subjuct title "This Car is a Tank". If you want to take a look. My question to you is: Did your air bags pop out? Its been two months since the accident and they just now determined that my air bag censors were defective. Im so pissed thinking that I could have died due to faulty equiptment. I luckly walked away but its not reassuring that i bought an expensive car with one of the major selling points being safety and the air bags turn out to be defective.

Re: Accident
The car has since been repaired and is now with the dealer having the computer rebooted. The light never came on for me but once teh accident occured it popped up but no airbag popped out. I hit several trees at high speeds and caused over 18000 in damages. what more does it take for those bags to pop out. To answer your question the dealer determined that the censors are bad.
