Got hit and her insurance won't pay
Ugh!
I was driving straight. Some woman ran a stop sign and racked by back end. Thankfully, everyone was OK, but my axle was bent and obviously all the rest you can clearly see.
Police came, wrote up a report, stated clearly that she was at fault. I filed a claim with her insurance and figured things would get processed once they had the report. I even faxed the report over to Allstate to get things moving. However, they kept saying they would have to talk to the insured. The thing that really complicates it all is that the woman driving was the mother of the insured.
Anyway, it's been a month now, and the insurance won't give. They say if the insured won't call them back, they'll end up denying the claim. WTF? Does anyone know if this is really how it works? I can go through with a claim with my insurance, but I'll be out my deductible, plus whatever it's gonna cost for the POS rental car that the chick at Allstate told me to go ahead and rent.
Just seems like there's gotta be some way to force the insured to talk to the insurance. If not, why would anyone ever talk to their insurance when they're at fault???

call your insurance and have them handle the claim. or get a lawyer but try talking to your insurance first or just get the car fixed thru your insurance and they will file a claim with the lady's insurance and if it gets denied your insurance will mostlikely take them to court
Damn that sucks Bro! I work at a body shop, and if any customers come in with anything dealing with ALLSTATE we turn them away! We don't deal with them at all!! Since they are a PITA to deal with, and never call back, or just take forever to process a claim! Never get Allstate for auto insurance! they don't want to hand u a check, or just make u go through all kinds of red tape! Screw them! Feel sorry for you Bro! hope u get it worked out soon, but with Allstate? u can pretty much forget it! they suck B*lls!!!
you should have gotten your insurance involved since day one... esp with that level of repairs... that's probably close to 8-9000 in repairs...
the officer should have given you a docket/file/report number. that should be all your insurance company needs. I mean it'll take a few conversations to explain why it's been a month... but the officer's report will fill in all the gaps. I mean you don't get hit in that area and have it be your fault unless you ran a red light.
but yeah allstate isn't great to deal with w/o some representation. you'll be alright tho, your insurance company will getter done.

You don't need a lawyer, you need to call your insurance to file a claim asap. It's not your job to get the ball rolling with Allstate--that's the job of your insurance company and why you pay them the big bucks you do.
Your company will tell you where to take the car for an estimate (if not already done), or they'll tow it to one of their authorized shops or shop of your choosing for repairs. Yes, you may have to pay the deductible up front, but once your insurance company gets the police report and finds the other driver at fault you'll be reimbursed that fee. You'll have to get the specifics about the rental reimbursement when you call your company.

Yeah i was trying to avoid getting my insurance involved. Figured it'd be better to just have hers take care of it, but guess that's the way I'll end up having to go. Beebo, thanks for the great link. That guy has the right idea. Maybe I'll see what I can pull off that way!
If you can't get anything going, then you should contact your state's government insurance agency. At least here in Indiana, you can contact them, file a claim describing what the issue is, and they'll look into it. If they determine that the insurance agency you're dealing with is at fault, they will kindly suggest to the Ins Co that they resolve the matter quickly.
I did this a number of years ago against state farm, who was trying to put inferior components on my car. They called me within 3 days of me filing the papers with the state's insurance agency. I got what was right out of it. They were more than happy to help then, where as before they wouldn't even talk with me.

Let your insurance company handle it, that's why you have it! Your insurance will pay for your damages then sue her Ins. company to recover the money laid out for your damages. Besides your clearly not at fault, shouldn't effect your rates!
I actually was involved in an accident recently too (reason why I have an M35 now) and the other party was at fault. You need to call your insurance company and make a claim. Give them all the info about the other party and their insurance and they should take care of it. I have Farmers Insurance and they declared my car a total loss. They covered the cost of the settlement to me and they go after the other parties insurance company to recoup the money themselves leaving me totally out of it. The deductable they took out of my settlement but then they get it back for you through subrogation. Basically if there's anymore out pocket expenses they also try to get it back for you from the other parties insurance ie. if you had to pay for you own rental you would tell your insurance company how much it cost and they will try to get it back for you from the other insurance through subrogation.

Thanks everybody, you've all been really helpful. I tried the state insurance agency, but they rattled off the same stuff to me that Allstate had already said. They did say after two months I could file an official claim, but it didn't sound very promising. I got my insurance going on it and it looks like in about two weeks I'll finally have my car back!
In the meantime, I called the supervisor of the girl I had been working with at Allstate and let her know the lousy service I had been getting. That night, the original adjuster called me to let me know she had contacted the insured, by tracking her down through her ex-husband. The insured claims that the car was stolen and is now filing a police report about that. Hmmm, interesting that it took her a month to bother to report that her car was stolen, but it's all of a sudden very important now that the insurance finally got a hold of her.
