No record of 30k service = warranty will be denied?

I bought the car with 36k on the clock. It just turned over 40k the other day. As soon as it warmed up outside, I began to feel the tranny shuddering on the freeway when letting off/lightly getting on the throttle.
I can flush it myself, but figured why not request the service records first.
It looks like even though the car was leased, the dealer says they could only recommend the 30k service be performed, but not require the previous owner to do it.
If I flush it now (which I will regardless), will I stand a chance of being denied warranty work in the future because the previous owner failed to perform the 30k service? BTW, I have 5yr/100k Elite plan.

I would hope not....because some people use outside shops or do it themselves so I don't see how a dealership can deny warranty for lack of service records & if they did I would fight them.

The service tech did tell me to make sure I keep all records of doing it myself in case I need to make a claim in the future.
My only defense is that I didn't own the car until 36k.

Just keep all your receipts and every time you do any maintaince note the miles and the services you did, as long as you have that info they can NOT just deny your warranty claim unless they can directly link the failure back to you.

To make things easier i tend to do the service and then take a picture of the bills(parts), a note stating what services i performed and cars odo all in one pic and save it in my comp.

I still save the receipts but if i loose em then i still have a backup with mileage and date so they cant say that i just made up the records, a bit of an overkill but takes only a few seconds.

^^ like kool said, if you keep a log or record of some kind (I write it in ink right there in the maintenance log book) and keep all the receipts for the services you perform, they cannot deny that it wasn't sufficient just because you did it yourself (as long as you truly did it properly). AS far as waiting until 40k to service the tranny, I doubt that is sufficient to deny claims. Is the service even required for the maintenance schedule #2 ? I find the dealerships like to act like you have to use their "Premium" maintenance schedule, but the truth is you DO NOT! Often, the maintenance isn't even mentioned in the lower schedules for many, many thousands more miles. Check the book first!

There are different levels of service you can do, some are more comprehensive. If you check the manual, the minimum requirements should be all you need to do to avoid voiding the warranty(schedule 1 or 2).
