Contesting a Ticket
Contesting a Ticket
yea, i just got a ticket for "disregarding a stop sign". it was rainning (lightly), so i didn't think any cop would pull me over. so i did a "rolling stop". this was behind comp usa area. at 9pm. so i was the only car to be seen. and the cop came up to my right as i was going threw the intersection. he said that i didn't even use my brakes. (but i could swear i did!) well it was the rollist rolling stop i've ever done. but the cop told me i should contest it. and he seemed pretty cool. so i'm wondering, (since i obviously don't wanna go to fricken court) can i just write the contest, and say that i did stop well b4 the sign, and it was wet, rainning, dark, and a building was obstructing the cops view, (which it was)? or just go to court and hope he don't show up? opinions? contesting stories?
your best bet is to do both. i'm pretty sure on the ticket it says if you disagree with the citation you can write the judge a letter explaining what happened and why it (the citation) should be waived. it gives you a certain timeframe to turn this letter in, i'd do it ASAP so IF you get any response, it would hopefully be before your court date. if you recieve an unfavorable or no response at all you still can go to court (with a copy of that letter) and contest the citation.
if you go to court, i'd use the fact that it was dark and raining against him. i'd take pictures of the area from the cop's perspective during the day and also at night. as long as he shows up, it's your word against his (which will usually go in favor or the police because now they have to pull him off normal duty, etc). BUT if you put a lot of effort into this (write the letter take pictures to court) it will only be better for you. as a judge i'd asked myself, either this guy really doesn't wanna pay this fine, or he's innocent. but if you go in there with nothing (just your word against his) the judge will probably slap you with the fine because it looks like you made no effort to prove your innocence.

Thats almost like beating a dead horse. Even if you brush on the brakes, you're supposed to be at a complete stop at the stop sign.
Try PMing G35Five_O on how you can try. I wonder who was the officer that pulled you over. A lot of the cops that patrol in that area are friends of mines from school and from the gym.
