Boston fights and LOL
Where's Mass.... I have a few law type questions.
Am I allowed to put a 9mm into the face of a guy who attacks me through my driver's side window while I'm driving down a street?
If not, am I allowed to at least grab him by his arm and then proceed to side-swipe a telephone pole in an attempt to do major bodily harm?
What a bunch of tool bags.
If they got a hold of that bat swinging kid... they probably would have killed him right there.
Good reason to always have pepper spray in the car at all times.

Re-fvcking-post!
Just use the "reasonable person" standard. If YOU were on a jury, what would you think?
Was it unprovoked? Did you slow or stop when they were being aggressive? Or were you blocked in? Were you legitimately in fear of substantial bodily harm or death? How much did you willingly and avoidably put yourself in that danger?
There is no duty to retreat in Massachusetts, but you also can't go looking for or willingly participate in a fight then start shooting when things go south for you.
Note: "no duty to retreat" is NOT synonymous with "Castle Doctrine", although Massachusetts sorta has that for people in their "dwelling". It is a DEFENSE that must be raised and argued during trial, not an automatic "you can't put me on trial for this" statute. See: http://www.mass.gov/legis/laws/mgl/278-8a.htm
There is no "duty to retreat" in Massachusetts while in public, including on a public way, because case law has never addressed the issue.
