California DMV Question

Long story short: I bought a 2003 Mazda Miata for my little sister earlier this year as graduation present/first car. The car is registered in my name but not insured under my name or even in my policy for that matter. When I bought the car she agreed to insure it with her own policy. Well turns out this morning I get a letter from the DMV saying the registration is suspended because it hasn't been insured for the last 2 months. My question is will the registration suspension show on my driving/DMV record printout? I really dont want anything negative on my record...

It should only be on the vehicle records and not your driving records. I doubt it will effect you but I would get that car out of yours and into your sister name asap... if shes in an accident, you may be liable.

You might check with your sister to be sure she isn't insured. It's possible that the DMV just never got a copy of the proof of insurance. We had that happen with our Harley. They said it wasn't insured and I just went back and got copies of our insurance cards and took them in with the registration. Sometimes DMV screws up...surprising isn't it?

If your sister does have insurance and the DMV said that she doesnt. Then all she needs to do is fax in the proof of insurance and they should take care of it within 24 hrs. I know that sometimes the DMV misses things like that. Insurance companies each week sends a list of people who do have insurance and the car might have been missed.

+1. Your sis may also have change insurance companies and when this occurred, her previous company notified DMV that she was no longer with them.

just show them proof of insurance.

while your there change it to your sis name.

Take the car out of your name. Problem solved. Or be the legal owner (like the bank shows on a reg. card if you are still paying on it) and make her the registered owner. Evidence of financial responsibility is a fancy term of insurance. I have seen plenty of suspended driver licenses because of this section. Basically this section gives the court and DMV the authority to suspend a driver license.

16070. (a) Whenever a driver involved in an accident described in
Section 16000 fails to provide evidence of financial responsibility,
as required by Section 16020, at the time of the accident, the
department shall, pursuant to subdivision (b), suspend the privilege
of the driver or owner to drive a motor vehicle
, including the
driving privilege of a nonresident in this state.
(b) Whenever the department receives an accident report pursuant
to this article that alleges that any of the drivers involved in the
accident was not in compliance with Section 16020 at the time of the
accident, the department shall immediately mail to that driver a
notice of intent to suspend the driving privilege of that driver.
The department shall suspend the driving privilege 30 days after
mailing the notice, unless the driver has, prior to that date,
established evidence of financial responsibility at the time of the
accident, as specified in Section 16021, with the department. The
suspension notice shall notify the driver of the action taken and the
right to a hearing under Section 16075.

Yeah i would just change the registration name. If she runs one of those red light cameras guess who is going to get the ticket? then it will turn into a big mess.
