In regards to your question about the iPod...
V.C. Article 1 Div 11 § 23123 (a) A person shall not drive a motor vehicle while using a wireless telephone unless that telephone is specifically designed and configured to allow hands-free listening and talking, and is used in that manner while driving.
And when it was revised on Jan this was added
V.C. Article 1 Div 11 § 23123.5 (a) A person shall not drive a motor vehicle while using an electronic wireless communications device to write, send, or read a textbased communication.
An iPod does not qualify as any of those described items so you could fight a ticket given for using an iPod...but not an iPhone!

Thanks Vin!!! Yeah, I would argue the same thing! I guess the element that has to be proven is whether the device is a wireless communication device? Ipod negates that element. But what about the issue about the manner in which the device is being used? Here Shane did not used the phone the way the code prescribes it! Iphone is a an Ipod also, so if shane was using a Iphone in the matter of an ipod, he should be allowed to use it, do you think? Sorry, just trying to bring my law school thinking into this issue!

thats definitely smart.. i was wondering how ud prove it just by showing ur phone cause it could easily be deleted on ur phone.. but not the bill
