Before buying any car it's advisable to get a CARFAX and have a qualified mechanic check it out. Had you done so you wouldn't have bought this POS since it needs so much just to keep it on the road. Going to court isn't a good idea, chances are you'd lose unless you have a document that states the vehicle was sold to you in perfect condition....sorry!

Unless any of what he mentioned was stated on the bill of sale then not much you can do.

One thing i do faintly remember tho, Isnt it a state law or something that if a used car is being sold it MUST pass smog? if not then the seller is responsible to make it pass?

This part is important. If those words are there, it's all over.

If not, then CA clearly states that smogging a car is the responsibility of the seller. If he guarantees it will pass, just take it down and have it fail (a check engine light will fail you right off the bat). You may still have an uphill battle, but it doesn't cost much to go to small claims court.

did you get anything in writing? if you had terms of sale, and everything you say that he said is stated on paper then yes you can file a small claims suite. IF not, you still can but good luck with it, I don't think any judge would side with you if not.

Dunno if you can sue, but as World Famous Z mentioned it's CA law that the seller is responsible for smogging the vehicle. 100 bucks ain't much. It costs a lil more than that to pay someone off even if you did that, but since you're buying the vehicle, gotta make them responsible. Sounds like he knew it wouldn't pass so he offered that deal to you.
