any problems if i run 255 40 19 on my rear oem 19

Depends on the size of your front tire. Use this: http://www.miata.net/garage/tirecalc.html

My speedometer is 1mph off due to my tire sizes which doesn't trip the VDC.

I'm running 245/40/19 front and 255/40/19 rear with no problems. Can't decide if I like the fatter rear tire look, but it rides well.

You'd probably be better off going with a 255/35/19 in the rear if you plan on keeping the fronts at 225. A 255/40 tire is going to be almost an inch taller than the 225, but the 255/35 will be only .1" shorter than the front which would be a better match for the VDC. And your speedometer won't be off by much.
