Fitting tires on the wheels don't only depend on the width, but also on how tall the sidewall is. For example, 245/45 series tires can be put on 7.5" wheels, but not 245/45 series tires. It also differs from tire companies as the widths vary slightly from one company to the other. I stand corrected about saying 245s are the max on 8.5" wheels since this didn't come to my mind when I posted. Oh wait... I was wrong about 245s being max... Just checked and found out 255 is actually is the widest tires that can be put on 8.5" wheels. My bad.
You can fit whatever you like on the wheels, but I wouldn't suggest going over the limit since they are set for a reason.

You are definitely in the safe range going with 265's on an 8.5" rim. That's an ~81% wheel/tire width ratio (215mm / 265mm), actually just about where you want to be.
Don't let people scare you with baseless theory, let the numbers do the figuring. Also keep in mind that tire manufacturers only recommend a very small range of tires for a specific size rim, in reality there is a larger "safe" range of sizes you can go with that people have been running for decades without any problems. Granted if some moron puts on ridiculously large or small tires bad things will happen, but if you stay right around the 80% wheel/tire ratio on passenger cars you'll be fine.
I would go with 255's on an 8" wheel and 265's on an 8.5" wheel.
