So they tried to rip me off....Please Read

Posted this over at myg37 and I'm interested to hear any and all opinions as I'm furious...So posting here as well...Coming from an 04 G35 coupe...

On Wednesday April 23rd I signed a lease agreement with a certain Infiniti dealership in the PA area...My lease agreement was set at a monthly payment of $498 per month...I assumed delivery of the car on that date and drove off the lot with the signed contract in hand...The only thing they asked was that I do a "courtesy trade" with my private buyer...Meaning they would handle all of the paperwork for me and the private buyer...Which would assure them that my old Infiniti loan on my G35 coupe would be paid off in full...

Fast forward to last night April 29th...Myself and my private buyer and his girlfriend meet at this particular dealership...The finance manager informs me that I'll be signing some things first, and then it would be my buyers turn...My sales guy is nowhere to be found...Finance manager sits me down and says everything is great...However, some hits came back on my credit report so instead of Tier 0 credit I'm now a Tier 2 (698)...So my new monthly payment is $581 per month!!!

I informed him that my sales guy NEVER mentioned anything about a new credit app...And that I even asked my guy on 3 seperate occasions if he was POSITIVE that I qualified for tier 0 because I knew I had some defaults back in my college days...After 30 minutes of me explaining that I never would have assumed delivery if I knew a change was possible he goes to speak with his manager...He comes back saying they can get me in at Tier 1 and my monthly will be $565...And that they wont complete the trade with my private buyer until I sign...I left the dealership and made a private exchange with my buyer of certified check, keys, and notarized bill of sale...

I've been told that they have absolutely no leg to stand on here...And that they need to honor my original contract, or come pick up the car "now used with 500 miles on it" and pay me back every last penny of my deposit...

Anyone ever experience this before? I'm considering seeking an attorney as I'm furious at what they've tried to pull over on me...Thoughts?

If everything was OAC (On Approved Credit) and this was listed or stated somewhere on the contract, they have the right to increase your payment based on your credit score if they are unable to secure you Tier 0 or Tier 1 financing. IFS recently changed their Tiering system about a month or two ago. I haven't read the specifics of it yet, but I do know that they're now being a bit more strict about allowing someone who is a few points short of a Tier to be bumped up one rung for better financing. The same thing happened with a customer of one of my co-workers. 698 Equifax but IFS wouldn't bump them which kept the payments out of their reach.

In any case, back to the original point. Yah. If it was stated on the contract that it was OAC, they'll more than likely be in the clear based on what you're telling me. If not, they only f**ked themselves.
