Minor accident dispute in Toornto

I was sitting at a redlight and was rear ended. Minor damage just her license plate bolts imprinted on my bumper. She offered to pay cash right there but I said I have to get an estimate. She said to call her and not to go through insurance.

I get the estimate the next day and tell her, she gets a friend to talk to me and he asks me not to fix it and for her to pay less. I said no I need it repaired. Anyhow they give me the run around, wanting to pay less, pay by credit card, by check etc. I said cash or I report it. Then they said ok but I have to sign papers her lawyer said to have written up. I said forget it I 'd rather report it to the police and insurance.

I do the collision reporting thing, then call my insurance this morning. They call her then call me back saying that she is now claiming I backed into her and I refused to give her my papers. Now I am waiting for the insurance to make a decision.

I refuse to accept any fault in this matter or to pay anything. She hit me she pays for the damage. Any advice on this situation?

well, the best thing to do is to report it right away.
don't ever agree to whatever they offer.
unless you can find some witness or else

What kind of BS is this girl trying to pull? I mean what the hell is she thinking? You should do something about it more then get your car fixed. But if you dont have witness during the accident then its hard to claim. Where was the accident?
Did the cop reply yet? And i think you should sue her!

The first thing you should do when you get into an accident is report it to the nearest collision centre. When you report it, you are given the right to have your insurance companies act within ONE year of the accident/report date. It is NOT reported to the insurance company by the police, although facilities are there for you to do so at these collision centres.

Another reason you should do it right away is because if the other person beats you to the punch it makes you look like the guilty party.

Yeah, this is all good and well but doesnt help you resolve your problem max.. =P

She wont get away with her shiestering... Why would she give you her info when you refused to give her yours (as she claims?)

If i was in charge of investigating this... i'd screw that dumb b!tch. If you are stupid enough to give out your info w/o getting the other person's when "they" are at fault... you deserve to get screwed. Judgment: max.

I think if you scan the driver's handbook it says both parties should exchange info. If she was competent enough to know the rules and her rights... maybe she'd be competent enough to drive her car without rear-ending someone. Obviously... incompetence runs all throughout her body...

My buddy drives a RSX-S, one of if not the first guy to get an ings kit on it... We were coming back from Tonic one night and we are on the offramp at 401 & Markham Road ready to turn left to go north. (We all know how the ramp slopes downward to the light.) Anyway... some white TL pulls up behind him and stops. All of a sudden... the TL rolls into my buddy's brand new bodykit leaving the same type of damage maxrpm described. He was smart to pull over... cuz little did he know that the M3 and Integra that were boxing him at the light were all in our crew on our way home... He refused to give his info. got aggressive as he didnt want to fess up to his stupidity. we called the cops. Cops came... Mr. TL was screwed...

I get too emotional when guilty parties try to screw innocent ones over.

I spent some time (6 years) in the insurance industry durring my past life and this is a real common problem.

The problem is that when you call your insurance company, they will ask for your account of what happened .. they will then call her isurance company to confirm that she has valid coverage and to confirm the details of the loss.

If your insurance company is unable to determine fault, due to , lets say .. conflicting stories, they call it a 50/50 accident .. meaning that you will be held 50% liable for your deductable as well as fault. That is unless your adjuster feels your pain and beleives you.

Are you driving an auto or 6 speed ? This may make a difference .. if your in an automatic, and have a 'witness or two' (best if they say they don't know you) then the odds are in your favor .. it will be easier for the claims rep to believe you ... cause ... WHY THE HELL WOULD YOU BACK IN TO SOMEONE AT THE LIGHTS. ....

Play your cards right and you should be ok ...

PS .. the insurance regs are different from province to province ... I am in Ontario and those are the rules that I am familiar with .. I could be worng if your area follows different insurance regulations.

Woo Hoo, my insurance called me today and said I am 100% NOT AT FAULT and they are going to issue me a check for the estimate I got and to go ahead and rent a comparable car to what I have. :]

Think I could rent a 911 or a Viper from Budget and say it's comparable?

Oh but they do, the one on Yonge and Summerhill across from the Shell station rents all sorts of luxury cars, they have a nice bright Blue 911 there, as well as Viper and Jags, Mercs etc.
