Speeding Ticket "help"

Hey guy's I got a ticket in september on the bike... Getting on the dufferin onramp going westbound on the 401. I was really flying with a buddy of mine and when I decided to let down on the throttle a bit a cop just flew out behind me and I had no choice but to stop.... I was going pretty fast and he gave me a ticket for going 40 over... NO radar or anything like that... heres the thing though....

On my ticket the police officer wrote CLEARLY "Speeding 140 km/h on posted 150 km/h zone"

Should I be going to a lawyer or will this get thrown out if I show up myself??? Any help would be great thnx.

Normally I would say if you were caught speeding just pay the fine and suffer any consequence.
No radar...did he say how he clocked you?
Such a big error on the speed, you might have a chance in court. I don't know if the officer will be held responsible, by the court, for writing down a posted speed that simply does not exist.

or... you might be able to argue that driving 140km/h in a 150km/h is perfectly legal lol. but hey, he wrote that...

if the officer made any mistakes then the ticket will be thrown out. Just go to court by yourself. That's a pretty big mistake

are u sure his writing didn't say 100 instead of 150? if its clearly a mistake of writing 150 then the courts are gonna let the ticket stand. but if the cop had no radar then it'll be thrown out

are u kidding me? that's the worst advice ever. a simple typo or mistake on the ticket isn't going to do jack squat for you in court.

40 over is going to be a big issue when it comes to your insurance company's... especially when it comes to your bike premiums.

take some advice from another biker and do yourself a favour and get a lawyer.

i highly recommend redline legal services. http://charged.ca/

still not convinced? go visit gtamotorycle.com and ask their opinions.

good luck.

okay buddy relax there! I understand that you might know your law somewhat but, I'm actually in Police Collage and I know what I'm talking about. There is no need for him to go and spend approximately five bills on a lawyer. I know for a fact that if a Police officer makes a mistake like that on a speeding ticket than it will be thrown out. You just have to go and fight it.

zxg35 if you have any concerns pm me and ill try to give you some advice.

I went to court to fight a no seat belt ticket and the officer made a mistake instead of writing driver he wrote me as the passenger and the judge told me if mistakes are made only HE can correct it. In the end he end up fixing it and I got convicted.

typos arent going to stop a charge (not always tho, typos will significantly affect certain legal documents like a search warrant)

go with what the above user said, go with one of those redline or points services. But just to clarify, they're not lawyers.

^ your right typos are not always going to stop a charge, it all depends on the typo. Im just giving my opinion since i go to college for this. There are always ways to fight it your self and win. This ticket can be won without a lawyer, but getting a lawyer is the safest way if you do not know what you are doing. I recommend Traffic Ticket Defence Ltd. I used them before and they are very respected in the courts. All of the judges know who they are. You have to be careful with other companies because they can take your money and never even show up in court, it actually happens a lot.

ps, i understand you think you know what you're talking about because u'r in police college....but im gonna give you some advice from law school and tell you never to give legal advice with being licensed unless u want to be fined with a 25,000-50,000 fine.

http://www.e-laws.gov.on.ca/html/sta...l08_e.htm#BK34

read s. 26.1 and 26.2

we specifically have those rules and take them very seriously so that we don't have police college students and other random people thinking they know the law telling others what to do

That happen to a couple of people I know and they ended up getting ****ED

Redpearl - I think its different if you give advice of what you know (or think you know) and legal advice. And it says for people practicing law they are the ones that can not give out legal advice.
