Another clutch warranty question

Another clutch warranty question

So during the recent heatwave, I was accelerating on an onramp onto the higway when I shifted from 1st to 2nd gear at about 6500 rpm and my clutch pedal only came halfway up. However, at that point, I think the damage was already done. I didn't get any of the burnt clutch smell that I would have expected, but after pulling over and starting from 1st gear, I could tell that there was something wrong with the engagement. Very difficult to get into 1st gear. Once I was going, all the other gears seemed fine and the clutch held well under WOT. No slipping. Well, i searched the forums as usual and saw that the clutch fluid was most likely the culprit for my clutch woes. Upon inspection, it was very dark and slightly murky. So i changed myself and followed the routine most on here did to remove most of the old fluid. Alas, no change in the clutch pedal, so I of course assume the worst and my clutch is ruined, drivable, but ruined.

The dealer quoted me 1300 without tax to replace the clutch and resurface flywheel. A local shop will do the same for $700. I may even just replace the clutch with an aftermarket street clutch and lightened flywheel by ACT.

My question is, is it worth pursuing this as a warranty issue with infinity? I feel like it should be as I have had all my oil changes and routine services done by my dealer. Should they be at fault for most likely not ever inspecting or changing my clutch fluid? I've heard people had sticking issues with their clutches over and over, but I dont think mine will be reproducible without more ill effects to the clutch and thus requiring a new flywheel. I've owned and driven several sticks before the g35 and have driven them all hard as well, but have never replaced a clutch yet. I too may admit that I was careless this time around, but dont think that was the reason for the clutch sticking. (Car only has 22,000 miles, but did have the engine replaced at 13,000 miles due to oil consumption)

Ok, sorry for the rant. What do you guys think? Do I have leg to stand on for warranty or just go local shop and/or aftermarket?

Clutch is a wear item like tires and the dealer will not replace it.

Your flywheel (oem) is a dual mass which 99.9% of the shops out there do not re-surface, they replace.

I had similar issues recently. TTrank is correct on both counts. The dealer quoted $2100 for a stock clutch and flywheel. I went with a JWT clutch and lightened flywheel which gives you the impression of more HP.

yeah, looks like I will be going. I'm not taking my car back to the dealer if they said they could resurface my flywheel.

get a lightened flywheel if you can put up with some additional vibration and noise

That's where they get to poke you in the anus. They'll get your car apart then say they can't resurface your flywheel and hit you with an additional $1100 for the stock dampened flywheel
