thank everyone.
i talked to the service manage and of course they did NOT admit fault, but they did agree to fix it, he said the same thing to me SPEED that they can sand repant w.e but i didnt want to do it so they will just touch the scratches and replace the door pillar. not the best solution but o well.

definitely call infiniti.

realize that the type of damage you have would have been "noted" when the dealer accepted the car because they would not want to be held liable for damage they didn't commit. that implies the damage did no exist prior to the dealer accepting the vehicle. take pictures of the car now, in detail. if you have pics of the car before, find those.

then call the GENERAL MANAGER of the store (not the service manager) and show him/her the damage. tell that person exactly what you want and expect. be specific, and do it in writing (ask for a signature as an agreement). if that person refuses to do that, call infiniti customer relations and tell them what has transpired and that you already tried to resolve through the top level of the dealership (you've done your homework). again, be specific about your demands when you talk to them if you want to get treated well and get the problems fixed fast.

asking for a whole new car is, imo, totally unfair at this juncture. new bumpers and replacement of all other scratched parts, rather than a paint job- that's fair.

EDIT: just noticed you said the pillars are damaged too. ****, that sucks. what the hell are the techs wearing?

definitely get in touch with the GM... meantion you will go to the local press if it isn't handled correctly. don't threaten... just state that failure to satisfy your situation will result in that. compliance will result in a handshake.

Have an attorney write you a demand letter and then hand deliver it to the general manager. More than likely they will hoonor the demand and repair your car.

I'm 95% sure my dealer scratched my left rear bumper corner, but I didn't notice it when I picked up the car because it was pouring and I just jumped in. I noticed it the next day but find it almost impossible that it happened on my watch (I'm **** and park ridiculously far away from anything). Since I can't prove jack squat I haven't done jack squat. Kind of sux, but I don't want to rant and rave like a lunatic and get some poor shop guy fired unless I'm 100% sure, and I'm not.

A couple of years back my '03 sedan was in for brake warranty work.

Get a call from service writer. He says your brakes are done, but unfortunately our lot guy clipped the right front corner of the car with a QX56.

I drive over to look. R/F fender crunched, headlight cover cracked and punctured, some scratching/scuffing on bumper.

I tell them I am not going to call lawyers or get crazy. I tell them I know several people in the car biz and just like in any other business, **** happens.

Service writer says the body shop that does repairs on our high end makes (they have several dealerships for Jag/MB/BMW/etc) is sending their appraiser over tomorrow and the dealership will handle everything. He says keep the loaner and he'll call when he has more info.

I tell him I want to be reasonable. I do not want to hold them hostage for (1) a new car; (2) lifetime free state inspections/tires/gas/details/oil changes/repairs/********; (3) money. All I want is my car fixed so that NO ONE will be able to tell it was crunched. I tell him that level of repair quality is attainable only by the best shops around, and he says the shop they will use is the best he's seen.

On his next call he says it's about $2,500. I ask to see the estimate, they fax. It calls for all new parts except for R&R of bumper, I say nope I want new, he says OK. After two weeks it comes back looking very, very well matched (they told me Emerald Mist was a Biatch to match). I give loaner back and take car.

Next day I look real close in better light, and on the top of the fender I see what I can only describe as dust under the clear coat (as if the color coat went on, then it got dusty and they didn't wipe it with a tack cloth before they cleared it). Take it back to dealer, another service writer looks closely and agrees with me (her family owns a body shop she worked in as a kid). Make arrangements to have them take car back and get loaner.

Get car back, paint is looking sweet. Oops, looking very closely now I see abrasions on the grille, could have been from the accident or done during repair. Service writer says no problem, we'll order one and install.

Go back later for that, and get it. Took several tries but it all worked out.

Being reasonable about this IMO has given me the benefit of the doubt on at least one subsequent occassion at the dealership, when it was time for the brake warranty to run out, the service manager made it a point be be sure I got all new pads and rotors when the rears were not technically at the limit.

you were very patient and reasonable, whiz and i commend you for it. but so was *your* dealer. doesn't always work out that way.
