I bought an '06 coupe 2 weeks ago with 45k miles. Have paid in full and taken delivery. Now hearing a whining noise from the transmission and it can be difficult to put into 2nd gear at times. Service department says the problem is a bad clutch and flywheel and it's going to cost me $2,400 to replace because not covered by warranty.
While at the service department I looked at the cars service history and previous owner cited the same issues at 35k miles but dealer couldnt replicate problem at that time.
I bought this car 2 weeks ago! Do I have any recourse from the Nissan dealer who sold it to me???
Any advice would be greatly appreciated.

Whining noise usually means a rear diff going bad.
Difficult getting into 2nd gear could be loads of problems from the shift linkage, clutch, transmission fluid, synchros etc. Try a garage other than dealership and get a second or third opinion.

You should have gotten an extended warranty. But I know how you feel.
When I test drove the car, it ran perfect. Weeks later. Things started popping, cracking and whining.
Within 3 weeks. The rear axle bolt had to be re-torqued (it was making popping sound everytime I went over a dip or bump)...
The transmission was making weird noise at low speed when letting off the clutch. Don't know what the dealer did but they fixed it. (metal on metal sound)..
Headlights were recalled. And whoever did it "rushed" it or never changed a headlight in their life and things were misaligned, bolts were missing. etc etc. Went back there and made them do it right. (waste of time).
When in for my 1st oil change and saw that they didn't replace the right bolts. And used whatever bolts they had laying around to put the under body cover back together. I saw 8 rusted bolts, 1 missing plastic screw... Didn't really car about this but still. How are they going to mix and match ugly bolts with my new ones?
Infinti wants to come off as a "Luxury" brand but their service is worst than that of Acura.
Maybe it was just this 1 dealership in Costa Mesa. (They have since closed their doors)....
Depends on which dealership you go to.
I'd suggest trying another one
