I am sorry to hear about your loss; however, I am glad to hear you walked away from the accident unscathed.
As funny as it sounds, that is the advice my insurance company gave me after an accident I was in a few years ago. Granted, they worded it slightly differently, but the gist was the same.
My story, for reference --
I commuted for several years over HWY 74 (Ortega HWY) here in Southern California and was driving home after a light rain one evening at approx. 10:30 PM. For those of you familiar with the highway, you know that there are several blind corners and fairly sharp "S" curves. I was entering one of said corners only to find a vehicle in my lane, stopped, with their high beams on. Instinctively I swerved to miss the vehicle and went directly into the left wall, crossing traffic (to the right was a drop/cliff that I had no interest in visiting the bottom of). To make a long story short...because I did not clip the other vehicle my accident was treated as a separate occurrence with myself being the only participant. As such, I was held 100% at fault. When speaking with my insurance company (Allstate) they recommended, off the record, that should I have the option of safely "clipping" the other vehicle I should do so. Given California traffic law it would have been the only way to cover my a*.
So what your saying is just nail the damn guy who cut you off and say what the hell. This guy is not going to get away with this &$%^* that he just did to me. Great advice I will surely employ your advice the first chance I get.

I'm late to this, but sorry for your loss. I feel really bad seeing those pics.
I agree with some of the tips people give. That's why I told myself not the steer away and avoid jack *** driver like that. They'd get away and I don't. I had that happened to me last year where two ricers were racing and ran me off the exit lane. I tried to avoid them and thus totalled my car. I didn't get any ticket but I didn't get any $$ for my car anyways since it's the old car that I used for commute.
So lesson learned. If they hit you, let them do. It's their fault.
