If you didn't modify it then it will be.

Also so long as you didn't blow the speakers by sustaining max volume levels. But even then that's kind of hard for them to prove. You've got statistics on your side - almost everybody has a problem with those radios, so they're not likely to ask questions.

yes, dealer will replace a new unit for you. Because they did it for me without a question. I told them the problem and they tested it then told me they will call me when the part gets here. Took me about 2 hrs of waiting and test drive the 06 becaue me and the sales were just bored. I was happy, but they might have to order the part if they don't have it stock.

^+1 - It's such a common problem that the radios are on frequent backorder. It took my replacement about 3-4 weeks to come in.

+1 - Same problem with the Bose in my 03 Max...they'll take care of it no problem. They didn't even ask to check it...I told the service manager over the phone and he ordered the new one. Mine was also backordered and took about 3-4 weeks.

My dealer didn't replace speakers nor headunit and blamed the driver side speaker cut off on the burned cd, since radio and genuine cds worked fine. He did offer to order me the headunit and see if that helps, but the problem disappeared, and everything works fine, so I didn't have to go back for that.

As far as burned CDs go, the Bose definitely plays some better than others. For example mine in the Max would play Sony CDs flawlessly but skip and cut out on Memorex or Imation. Once I figured that out and started burning everything for the car on Sonys it played great.
