Dude, that's why you should always call and wait for the cops. The other driver can wait or leave, their option, but if they do leave then they are "leaving the scene of an accident" which I believe is a crime in most States.

Here's something for the insurance companies to consider-- Why would you be so eager to snap a dozen pictures if you'd been the cause of the accident? I recall in a Psychology of Law class, we learned that people don't often take pictures of accidents they caused; who wants to remember their idiocy? Anyone in a decision-making capacity should know/understand this.

Cops can't really make a comment on the cause or guilty party unless they see it. Furthermore, a reported accident goes on the VIN # of the car and the motorist. If a minor accident and dealing with a good party (SC430), I'd deal purely with the insurance company. Furthermore, based on the accident pics, one would conclude that he hit you while not seeing you in his blind spot. Not many people run into other cars in the way you would HAVE HAD TO run into him to cause those damages.
I'd would file agains his insurance company and wait. If you don't have his insurance info, go to the DMV and file for it, they always have that info on record.

It's not "leaving the scene of an accident" -- they have a different term. It's called "hit and run." Here in SoCal, though, if there's no physical injury, the cops generally don't even want to come.. just exchange insurance info and move on.
Just file a claim with his insurance. Always be calm with the insurance agents. If they don't cover your car, go through your own insurance company and give them the other insurance company policy number and such, and let your insurance company's lawyers battle the other insurance company's lawyers.
The location of the damage (your front fender, his rear fender) and the scrape directions will back up your story.

Here in Florida it is "Leaving the Scene of an Accident". Sadly though we are going the way of California, where the police do not want to come for damages of $500 and lower.[img]/w3timages/icons/frown.gif[/img]

Hey man, I had the same thing happen to me. Some girl merged into my lane as I was going straight. My insurance company sided with me. They went after the girl who hit me. It's pretty apparent that it wasn't your fault. Just let your insurance company handle it that's what they're there for. Don't worry about it too much. As long as you're ok, that's all that matters. Your car can easily be repaired. Remember you can have the car fixed wherever you want no matter what the insurance says. My suggestion is to take it directly back to the dealer. Peace.

Actually Now Police Do Not Come out unless Some Is Hurt. Or If You Are driving a City, County, State or Government Vehicle. Then they MUST come out to take an Accident report. Good Luck with your Claim!

Wow! Danny I'm sorry to hear about your accident. Seems so strange that it happened right after we left Stillen running to get away from the downpour. Was it raining when the accident occurred?
I think everyone has covered most of the angles and I have to agree to let the lawyers duke it out. That's what we're paying them to do.
Trying to be the devil's advocate, I'm wondering if there is a percentage of fault that his lawyers will try to pin on you since you didn't yield?

Obviously, if you wrote a report (or a witness did) stating that you knew he was attempting to come into your lane and you didn't yield but sped up instead that's going to be a problem, regardless of the scratch mark evidence. Not advocating lying about the facts but sometimes there are things you might just want to omit.
Were there any witnesses to the incident and did you get their names, numbers and statements? Hopefully, if there are witnesses, they won't portray this as two macho guys road-raging or playing chicken with their hot-rods. Then you might be saddled with a percentage of blame...

EXACTLY SAME thing happed to me on June in my G... the lady in the other car said it was her fault blah blah... she didnt wanna called the cops so... being nice me, i agreed... got her info blah blah blah... guess what, its amost 6 months after the accident and i still havent got my deductible cuz she made some bull shiet story up... every1 told me, even my insurance company, that it wouldve been over LONG time ago me w/ 0% fault n her w/ 100%...

Ok, it's been said already....but to those of you advocating a police report.....the police in Los Angeles(countywide) will not come out to an accident unless someone is hurt(something necessitating a 911 call). They wont even take a report, even if you go to the local police station.

you should've called the state troopers so that you could get an acutual police report of what happened and the cops will actually tell you who's fault it is. This way you could use the report for your insurance company. That would've been the smart way to handle it.

CHP (the "State Troopers") generally go by the same rule of thumb as the local cops in LA and SD.. minor fender benders with no injuries are left to the owners and insurance companies. There are simply too many cars and too many traffic accidents for them to deal with every one.
