yea i could of totally avoided this accident, but he could just go behind me instead of trying to cut me off and then hit me. If he used his signal on and had the right amount of spacing then I would for sure let him in

As much as it appears that it his fault, if you could have avoided the accident but didn't, you are at fault. In this case, your best course of action is to say there wasn't enough time to avoid him (plausible) and that you did try (hit your brakes as evident from the photos) but had nowhere to go.

With that statement and the photographic and physical evidence you have it shouldn't be difficult to make it a 100% fault on the other driver. If they can illustrate that you were driving aggresively and that was in some way causal to the accident, then you will be at least partly responsible for the repair costs.

Remember though, that the passengers in the same vehicle are not counted as independent witnesses. Only 3rd party observations are considered objective. This means that testimony from his passenger won't carry as much weight as you may think.
