Don't talk to their insurance company!

Turn it in to yours and let them deal with it. That's what you pay them for.

I am totally agree with John. Notify your insurance and forward that truck insurance information so let their agents work out their paper trail. Hopefully, you would already have that truck information; license plate, Dmv and insurance. Then your insurance would send their adjuster out to inspect your damage; in the mean time, if you have a rental car in your insurance policy, you would able to use it while your car get fix at the shop. Still, it's suck to pay extra out of your pocket!!! good luck and stay kool!

This is a good idea, but I think you should show the truck's position (behind you?) before the turn - as you show your position before the turn.

new york state no fault is a crappy law.

last time someone hit me i never went through my insurance and the other party paid out in less than one week on the spot at the body shop. it depends who's the other party's insurance but usually commercial/business insurance pays out fairly fast especially looking at the point of impact. if the officei wrote the correct information on the police report you should have a better chance of gettign paid and not having your personal rates go up

^^Listen to da mayor. I am an agent in Texas and if you go to your personal insurance co. Guess what you get a not at fault accident tacked on to your record. They may tell you sir this won't affect your rates thats bs! Cause if you have to change insurance carriers in the next 3 years it will show up and you will pay more $$$ than somone with a clean record. I have 15+ yrs in the auto insurance industry. Please don't just turn it in to your insurance cause thats why you pay for it. Thats short sighted and ignorant. If you need any further info pm me I'll try to help. Granted I don't do business in NY but claims are pretty much paid by the same guidlines.

If its a company owned truck then go right through insurance..Don't even bother with trying to get them to pay out of pocket. If its an individual owned truck..they may want to salvage their insurance. Either way I'd make sure the police report is accurate and push to go through insurance. If they are paying up front for all your damages then its all good. However, you should definitely not be at fault for anything from the looks of your diagram. As for the bodywork man if you need help regarding that..don't hesitate to contact me.

+1 It's always a good idea to report it to your insurance company. This will protect you just in case the other guy's insurance doesn't come through. At least you can make a claim on your insurance first...that's if you have "uninsured motorist" coverage. Your insurance co. can pay you for the damages sustained in the accident and will attempt to "suborgate" the claim to the other party at a later date.
