total loss?

I regret to have to post this, but I need some advise. I got in an accident in my coupe on 11/16 in San Diego. I was going straight around 50mph on Miramar Road westbound, when this camery decides to pull out of a driveway trying to go eastbound. Pulls out right in front of me, I slam on my brakes, but my front left got jacked. Police report is in my favor, other party's liability, violated right of way.

Car's in the shop, estimated damages of $24k, new front suspension, basically entire new front end, OEM parts. Insurance is kinda keeping me in the dark. Shop said they get red flagged when the damages reach 65% of the value of the car. Does this mean my car is an economic total loss? Insurance company gets really touchy when I say "total loss." I read that an economic total loss is:

repair costs + deminshed resale value + reimbursement of rental car costs.

I really would rather just get a new one. I don't feel particularly safe, even though the repairs are under a lifetime warrenty. I just hate knowing that the car has been in a serious accident. It was a laser red 2003.5, 6mt with 3305 miles.

Re: total loss?

I'm no insurance agent, but definitely push for a total loss. Like you said, you wouldn't feel right otherwise. So, fight for it. As I've been taught, the worst thing they can say is no.

Re: total loss?

if the damage to repair the cost is approx $24k, isn't the diminished value several thousand dollars?

If the insurance Co. will not "total" the car, tell them you don't want it fixed. You want a check payment for the repairs, the diminished value and the rental. Which sounds like it would nearly equal the price of a new one... and you would still have the wrecked coupe to sell to make up any difference.

If they won't do that it's lawyer time!

Re: total loss?

I was in a similar situation and didn't push for a total loss and I ALWAYS regretted not doing so.

Re: total loss?

Agreed. Make sure you press them for accellerated depreciation (that's what it's called in Canada). Accellerated depreciation is applicable only after a few thousand dollars in damage.

......i would also contact the person that hit you, directly. Tell them you are having problems with their ins co, and if you do not get it resolved you will be filing a lawsuit against them personally.

Re: total loss?

you probably saw my car as i posted the pics from my accident about a week ago.. the thing is, it really depends on your body shop and your claims adjuster.. the body shop can do a quote on your damages and understate them so that they do fit under the ~24K quota.. the reason being, in the situation of a total loss, they don't get the job of fixing the car.. the insurance company will take ownership of the car and have one of their inside repair shops fix it up for a much cheaper price.. it is a brand new car, so the insurance is not likely to give it to you.. like i said, it is under the claims adjuster's discretion too..

in my case, i've decided that i'm leaning towards a total loss, but if it doesn't end up being that way, i'm fine with driving car.. i kno the people at the body shop and they do some awesome work.. another thing, make sure that they order OEM parts.. some shops order imitation stuff, and that's definitely when the car is not the same.. either way, if i get my car back, i intend on driving the car up to the point of the standard warranty and trading it in for another car (maybe the new G at the time)..

Re: total loss?

Yea, you don't really want a big accident thing on the car's record for the rest of your ownership. I'd push for total loss, or a check for all the money they would pay anyway.

Re: total loss?

CSAA generally flags a damage estimate if it reaches 70%..........Farmers approximtely 75%-80%, but of course this really depends on the adjuster who has a lot of discretion on these issues. Why they go for 70% because there could be supplemental claims following the repairs, which could then cost them equivalent or more to repair the car than the value of the vehicle.

Push for a total loss........

Re: total loss?

Sorry to read about another crashed G. I crashed mine a couple weeks ago and am trying to research what is ahead of me in this unfortunate process of repair/total. Any update on your situation? You have any pics? I'm ever curious as to how much damage equates to $$$.
