bolted or otherwise attached as a unit to the vehicle, including, but
not limited to, the hood, bumpers, fenders, mechanical parts,
instrument panels, moldings, glass, tires, wheels, and electronic
instruments, shall be excluded from the damage calculation, except
that any damage having a cumulative repair or replacement value which
exceeds 10 percent of the manufacturer's suggested retail price of
the vehicle shall be deemed material.
(b) The damage was to the frame or drive train of the motor
vehicle.
(c) The damage occurred in connection with a theft of the entire
vehicle.
(d) The damage was to the suspension of the vehicle requiring
repairs other than wheel balancing or alignment.



9991. Every dealer shall disclose in writing to the purchaser of a
new or previously unregistered motor vehicle, prior to entering into
a contract for the vehicle or, if unknown at that time, prior to
delivery of the vehicle, any material damage known by the dealer to
have been sustained by the vehicle and subsequently repaired.





9992. Every dealer shall disclose in writing to the purchaser of a

For an FYI the dealer did not put anything in writing that there was frame damage what so ever. Would this be a legitimate document to take the car back to the dealer?
good work!

now just go down there and talk to them about getting you swapped out for a new one. they'll be happy to do it I'm sure and maybe you can even get them to throw in some service for the inconvenience orother perks.

most dealers want to keep you as a lifetime customer and will generally do whatever they can to make you reasonably happy and keep lawyers out of their door.

So here's the update on my situation. I went the dealer the other day, they pulled up the Carfax and that it said "Frame Damage". So they told me to get a 3rd party to inspect the frame. If the 3rd party says it has frame damage then they said to bring the car back.

Does anybody know any good frame inspection shops around the Bay Area, preferably in the San Jose area?...

Also, does anybody know how accurate is Carfax?

in order for carfax to honor their guarantee, you have to register the vehicle VIN with them when you check prior to the purchase...
they are only as accurate as the shop who performed the service/work to report what they did...so if a mom and pop shop doesn't report it to the DMV or wuteva, it doesn't get logged into carfax...

I'd go down there with a lawyer. That's a screwy deal that you got if the frame has damage.

Yes, I acutally went to the dealer, spoke to the GSM and he told me to get a 3rd party inspection. But I think that's a real inconvenience for me. To take my time and go get my car inspected. They should've inspected the frame before they sold the car to me.

So, I'm trying to find a decent good Lawyer to help me out... Any Lawyers out there?...

easy to go get a 3rd party inspection, go to a frame repair expert and have them inspect it. they'll do it free if you ask them to do a quote on it.

Ask the previous owner for a copy of the shop work. Can't get any better than that.

Well, first off I'm sure there is an ENORMOUS amout of mental anguish associated with learning you bought a car with frame damage. Then you have to consider all of the sleep you lost over the deal, and then there is counseling so that you can begin to trust people again.

Then you have court costs, missed work, probably uneven tire wear as a result of the damaged frame. I'm sure a good lawyer can come up with a few other things which require monetary compensation.

Of course it's absolutely rediculous to try to sue for all of these things, but hell, it's the American way so get a lawyer and SUE SUE SUE!

^ sorry in my rush to judgement I didn't realize you were kidding...

good luck convincing a judge that it's legitimate to sue for non-economic damages b/c of a lemon.

Hehe, hence the term "Pain and suffering", which has no real material value. I would tell the dealership that it is already in the system (Carfax) that stated it has Frame damage. That's all the proof you need. It's now up to them to prove otherwise. At least that will be what I'll do or say "Fine, I'll get it inspected but on will bill this all back to you, including a lost day of work.
