Right-- if one insurance company will take money from yours, but yours will take it from the one behind you and so-forth, then it would play out that way. If there were any sort of police report, however, it would show conculsively that you were not at fault, and thus not liable. Don't know WHY insurance companies would do that (SO MUCH PAPERWORK!).

Mike, sorry to hear about the accident, thankfully everyone is OK. Let us know how the insurance claims pan out.

BMW, I think even though Mike was able to stop before he hit the vehicle in front of him, the fact that he hit it after impact means he was too close. A safe distance would have prevented him from striking the vehicle in front of him. That's what the insurance company would say anyway. I know it sounds silly since Mike didn't do anything wrong. Hopefully it won't affect Mike's insurance premium.

I'm sorry, but I don't get it. He may as well have been parked. He's not responsible for his safely stopped vehicle being forced into another's. If I'm wrong about this, then someone please shoot me because the world has gone mad...

"BUT FOR", everyone... Whoever caused the chain of events caused the accident. There's contributory negligence, but that doesn't really apply here. State laws usually are incredibly ambiguous about a "safe stopping distance" (ie. "when you can still see their wheels", not "10 feet"). If he was stopped 20 feet away and the guy hit him at 100mph, he would've still hit the car in front of him... when is a certain distance deemed "safe"?

Funny thing that was brought up before...Police Report.

I called 911 to report the accident and was told that Police were not sent out to collisions unless someone was injured.

Now I have not been in an accident of this force before, so I did not know what the protocol was for a police report in CA. I guess the local police were too busy with all the other accidents going on that day.

You shouldnt call 911 in that kind of accident. If you want a police report, just call the local police dept. directly and they will try to send a squad car out to your location.

Yeh in MASS its the guy who hits you from behind and then pushes you into the car infront of you .. is all his fault. As long as you were at a complete stop.

I hope everything is ok but you should go to a doctor and check up just in case.

When I called 911, they in turn put me in touch with the Westchester police, who told me that they were not coming out since no-one was injured. I just wanted to call 911 to cover my bases.

I went and saw the car today and took pictures, but I will have to upload them tonight. She is heading over to the body shop today.

Looks like I might have to miss the next Socal meet (or else I will come in my MR2, he he).

That looks like it will get fixed. I doubt their going to write that off. The only part that looks bad is the back quarter. Keep us updated on what happens
