Out of state Speeding ticket, what to do?
This past weekend I was on a road trip with my friends for a bachelor party, we were all driving along at 80 mph in a 70 on a 4 lane highway and I was following another car. We come to a straight open strech of stretch of road with no other cars around and no trees or areas that a cop could be hiding behind so I decide to pass the guy I was following a show off a little of what the g can do so I take off and floor it and immediatly get it up to about 110 at which time I see a cop driving on the other side of the highway and completely let off the accelerator, so I was only really speeding for the 5 seconds or so while I was acellerating. The cop sees me cuts accross the highway divider and pulls me over giving me a ticket for 105 in a 70, but he said he didn't write it up as reckless. This was in west virginia and I'm a maryland resident.
The question is what should I do? Should I get a lawyer, can anyone recommend one since I don't want to drive back to west virginia to fight this? Would the cop have been able to tell my speed with radar since he was moving and on the opposite side of the highway or was he probably just guessing based on just looking and seeing me pass my friend. I know this won't affect my DMV points since this was out of state, but what will this do to my insurance points. Do I have to worry about having my license suspended, I only have 1 point currently on my record.

You should have asked how he determined the speed. Was it through a radar gun or was he just guessing. Then you could have asked to see the reading.
I think they can determine your speed with a radar device since their equipment should be smart enough to compensate for their own vehicle driving speed.

First thing to do is to check on your state's participation in the driving coalition (not the right name), it's the group of states that DO Exchange violation information. Read the fine print. Not all violations are moved back and forth. Some do DWI only, etc.
If your state does not have an arrangement with the state you got the violation in just pay the ticket on-time and be done with it.
I live in NYC and received a speeding ticket in NJ on my way down the shore and I paid the fine happily. Points do not move over from NJ to NY licenses (reference the nydmv website if interested in the policy).
Hope this helped.

I read the coalition thing and DMV points won't carry over, but the violation will so the insurance points will probably still be assesed. The question is how many points will carry over and would it be worth it to fight it rather then pay it. I don't care about the fine itself, but if this thing is going to cost me more then $1000 in insurance I'd rather get a lawyer now and try to fight it. I also don't want to call my insurance cause I'm afraid if I do they will raise my rates after I tell them I got the ticket regardless if I fight it or not. Given that I was the only one on the road besides my friend, I was clearly speeding, but it was only for a brief time and in the opposite direction of the police, so do I have any case for lack of proof and is there any way I can find out how they actually tracked my speed after the fact.

How are you going to find the CORRECT SPECIAL ATTORNEY WHO can solve the problem in that juristiction.
Bet he cost you more than $1,000 and you will be required to be in court.
Speeding tickets [over 100 mph], the gift that keeps on giving.

Just pay it and forget about it. My dad, NJ, got a wv speeding ticket and it never showed up on his license or insurance.

In addition to what everyone else has said here is some info that may also be helpful. I got a speeding ticket in another state and called the number on the ticket and simply asked if per their state laws was I able to represent myself or get an attorney. The person came back to the phone a minute later and said the fine has been reduced to a minor infraction. Vola, no points, a small fine etc,. What I would also suggest is to find out the things the other posts suggessted and also find out what the laws for that state are for the way the cop supposedly radared and ticketed you. Find out if they have to send you a deposition etc,. If so make them believe you are coming to fight it and ask for the deposition if it applies. You can hire a paralegal from NY or that state to get this info if you don't feel up to it. The knowledge of that States law is going to be the key to getting off. I would also feel out your insurance company or any NY company to see how this will really hurt you if it sticks. This will allow you to see what course of action you should take.

I already called the court and asked them about traffic school or any other way to reduce the points and they said that the only way it would be changed it by pleading not guilty and going to court.

As long as you do not cause your auto policy to be reviewed for any reason (like adding or changing coverages) by your insturance company they will never know you had a violation. They only go out and search on the accounts that have activity. This applies to most of the large carriers. The overhead is too high to scan all of the policies regularly.
The one speeding ticket i received out of state never appeared on my insurance. I never gave them a reason to scan my policy.

Re: Out of state Speeding ticket, what to do?
Well I just got a speeding ticket a couple months prior to this for 10 mph over, my first in 4 years, and I recieved a certified letter from my insurance carrier within 2 weeks of pleading not guilty that my rates were going up by 25% cause of the infraction so I don't think I'll get so lucky. And if a single 1 point ticket rasies my rates by over $500 a yr i can just imagine what a 4 point one will do.

Are u guys sure about the out of state thing? I just got a ticket for driving 60 in a 45 (construction zone, even tho no construction was in sight >:0 ) in Connecticut, and I am from New Jersey. You think the points won't transfer? that would save me like$800 in surcharges. what do u guys think?
