I don't know how this happened, but I know somebody who was hit by an uninsured motorist. The police even ticketed the uninsured motorist, and it was determined they caused the accident. The uninsured motorist sued the insured motorist's insurance company (or him, I can't remember), to get coverage under their uninsured motorist policy or something, and they actually won?!

yes, the car belongs to me, i pay for it. but its under my mom's name for insurance so i can and my mom can save money, we all know insurance for "new 35k 2 door car, young driver" = lotta $$. car under her name is just cheaper.

Excellent, excellent post! The only thing you forgot to mention is that if an "uninsured driver" hits someone, the insured person who is not at fault loses his or her deductible for collision. If the not at fault driver has a $2000 deductible they can take the "at fault driver" to small claims court, or even worse REAL COURT and sue them for their deductible, bodily injuries, medical expenses, pain and suffering, lost time from work, rental car reimbursement and other items that their own car insurance may not cover.
This has the potential to get <font color=red>much worse</font color=red> than it currently is. IMO, xkoraznboix needs a lawyer and he needs one badly...
It would be interesting to know if xkoraznboix is over the age of 18 and can legally protect his mother. If not, she may be really screwed in this situation.

and you cant forget that the bank that his G35 is bought or leased through, will want the vehicle put back to original condition and returned if its a lease. if its a purchase, they will want proof that the car is once again insured.
Its gonna be long bumpy ride for everyone involved.

As far as needing an attorney, it depends, as I said before. I mean seriously. The situation itself is quite grim. Getting a lawyer may not help any. Who knows for sure. Worst case scenario, the outcome becomes the same with or without an attorney and now you owe the attorney money too. If it were me, I'd probably wait to see what happens and find out what is actually being claimed before I resort to getting an attorney if at all. Perhaps make sure coverage won't be afforded on the policy. Again, each person has to make up his own mind on this. And I am not in any way saying not to get one, but to make sure it is in your best interest to do so.

i think blitzjb was just trying to lighten the situation. we all know how tough it's going to be and sympathize with you. just think of this as a lesson learned -- fast, new car + young driver.....don't skimp on the insurance and try to put the car under someone else's insurance to save money. honestly, i've seen this happen too many times--either somehow the insurance lapsed or complications occurred after an accident and the insurance wouldn't pay up. it's not worth the trouble. not to be the one to "put salt in the wound", but ppl should realize that if they can't afford the insurance, they probably can't afford the car.

get a lawyer, its not gonna be pretty if u go without one. cuz either way ur gonna be out paying big $$$. sorry about ur misfortune though, i got rear ended the other week as well.

Get a lawyer, do you live in the same house as your mom ? does she have insurance on a current auto ? If so you may in fact be covered. call the insurance co asap explaing what happened they will tell you what to do. From there get a good lawyer. As long as she or your mom has insurance you most likely will end up only paying to have your own car fixed. Accident attorneys have a way of getting it covered by the insurance co's and yes even if you dont have any. If honda lady gets greedy and comes after you personally you can counter sue , why ? just because you can and it might make her rethink it.

hey guys, here is the update.
today i talked to my uncle's lawyer friend, he told me to stay put, wait and see what happens and then take actions. so im waiting.
funny thing tho, few hours after talking to him, my insurance company called me and asked questions about the accident and gave me a claim #. just like they would as if my insurance was current. (i kno how it works from previous accident) just simple stuff like, are you hurt? what are the damages to the car? here is the claim #, ur adjuster will call you soon. (i didnt ask any questions about my insurance status) looks like the Honda girl is going thro insurance, you guys think im "saved"??

The adjuster is just responding to the honda ladies report, there is no way they are going to defend or pay a claim if the policy was cancelled. Are you positive it was cancelled? What carrier is it?

im pretty sure it was. its farmers insurance. the lady called me said she was my insurance company, not hers. that honda girl made the claim, they are going to see whos fault it is. i really dont get it. im sure it was cancelled.
