An insurance company still has to investigate a loss when it is reported. Gathering information is important to determine if there is coverage for a loss. Unless the coverage issue is resolved and they are affording coverage, you may expect to see a reservation or rights letter in the mail which is basically a notification you sign to confirm that you understand that by them investigating all aspects of the loss does not waive their right to deny coverage should they determine that coverage was not available on the date of the loss. If they do not, they can easily put themselves into trouble by estopping themselves from denying coverage later. Especially if you make any kind of a financial commitment as a result.

From the sounds of the call you got, the caller was probably just a contact center person that was gathering basic info about the claim. The actual adjuster will probably get into more details about the coverage issue. Most companies have systems that warn adjusters when that have claims with coverage issues that involve cancellations or losses that occur outside the coverage dates. Being a basic type of coverage issue, it would be doubtful that they miss it.

im sorry about your loss. it seems tho to me, you are at fault. if you get a lawyer and he does whatever legaize he has to prove you are not at fault here, the girl driving the honda is kinda screwed...

it is a bad situation all around. as the driver of a car tho, you need to make sure:

1. you are insured. doesnt matter what your mom says. this is your responsibility as a driver. you are old enough to have a licence, you are old enough to make sure you are insured.

2. if someone doesnt let you into their lane, it is not their fault. they have no legal obligation to do so. you should make sure the lane is clear before changing lanes.

3. if you are sucessful with the lawyer, you are pretty much screwing the other person. if they have uninsured motorist and they will not take the hit out of their pocker, fine. i think corporations make enough off the average driver to be able to pay for both cars. an individual, on the other hand, does not.

again, i say, this is a bad situation all around. i totally feel for your loss. at the same time, i have been hit by an uninsured motorist and had to pay for my damage myself. to sum it up, it pretty much sucked.

if it were me, i would have let you in the lane. not everyone feels this way tho. they think right of way is right of way. :? still, you need to be careful. your car prolly means alot more to you then her ex honda. im saying this cause of the pride of ownership is different in both cars.

either way, good luck in whatever happens. i am not trying to be negitive, but this is how i see it. i hope your g and her honda both get fixed. good luck, be safe. :/
