Lady hit my bumper.. Questions about how to get paid.

Lady hits my front bumper.. It's cracked and needs to be replaced. its not bad.

She and I would rather not take it through insurance but this is the thing.. with that being said i got a quote from Nissan, which is about 1200 for the spoiler, bumper, parts and labor.

I really don't even care about getting the bumber, so I'm trying to find a way to just pocket the cash.. but shes paying with a check and giving it to me, shes making it payable to. "Antwerpen Nissan AND my name". She knows how the game goes and pretty much doesnt want me to keep the cash, but this is a time where i could use extra cash. So this is what im thinking..

1. Since the check is wrote with AND, me and nissan will both have to endorse the check to CASH it. (i dont think a manager from nissan will sign the check)

2. Go in nissan with the check and just buy something like a window motor, and hope they give me the remainder in cash. (dont know how that would work.. or if its even possible)

UPDATEEEEEEE: Thanks for the help everybody. I just got off the phone with her and explained that it really doesn't matter wtf I do with the money.. either way she owes it. she says i need to go to nissan and verify that that is the correct price, i faxed her the paperwork from nissan. So i told her if you don't give me the money for me to spend im gonna get insurance involved. than she says im very busy and cant talk to you tmw, and hangs up! So i call right back and she says I cant wont be able to talk till tomorow and hangs up again. I'll just call back in the morning, I'm hoping this is something where she doesnt have insurance on her car.

Any suggestion or advice is appreciated.

+1, she could pull a fast one.

You could get 1200 worth of parts and resell it here. It won't be cash in hand right away but you'll get it eventually...

smart lady, tell her you want cash cause you don't trust a check if shes not okay with that then go thru insurence, if shes giving you a cashiers check u can't use this excuse lol

Bottom line is she hit your car and she needs to pay, what you do with the money is not her business. All that she would need is an estimate to make sure shes not over paying...If she doesnt like it, then let her know your going to report it to the insurance...

depends on what state your in, there is no police report unless theres injuries or city property was involved or some type of crime involved, i.e.: Hit & Run, DUI...but photos and a exchange of information is important.

After all, you're doing her a favor by not reporting to insurance; so you should have MORE bargain power here.

Big +1 to that. She needs to pay you what the damage is worth in order to make it the way it was prior to her hitting you. What you do with the money is not her business. When the insurance company gives you a check for damage, they don't force you to give it to a body shop...it's yours to decide how you will spend it.

As far as check vs. cash goes, obviously cash is going to be the most secure payment method. Otherwise, I'd request a cashiers check or money order. I would recommend against a personal check because the person can cancel that check weeks later and they will withdraw the money from YOUR account and you'll be left high and dry. I know this because it's happened to me.

Do it quickly too. The longer the whole process takes, the less likely you are actually going to get ANYTHING for it. She's going to start thinking about it, talking to other people, and eventually bail on you. I know this too because it's been done to me.

File a claim and get your car fixed. I understand the money situation but some things just dont pan out. Good Luck.
